  8. This file, LICENSE.DOC, describes the only terms by which Metropolis Software
  9. House ("Metropolis") permits other parties to distribute this program, the
  10. shareware version of KATHARSIS (the "Software"), throughout the world.
  11.

  30. │ 1. Distribution by electronic means: │

  34. Metropolis grants you the right to distribute the Software by electronic means
  35. (BBS, FTP, etc.) as long as no files are altered or removed. If a distribution
  36. fee is charged for the Software, you must additionally ensure that:
  37.  
  38. a) Metropolis Software House is credited as the publisher of the Software;
  39. b) The Software is identified as shareware;
  40. c) The shareware concept is explained adequately elsewhere online;
  41. d) You charge less than $10 for downloading the Software.

  44. │ 2. Distribution of single programs by floppy disk: │

  47. Shareware vendors may distribute the Software alone on a floppy disk if the
  48. following conditions are met:
  49.  
  50. a) You explain the shareware concept and describe the Software as shareware.
  51.    (Shareware is "try-before-you-buy" software, and the price paid by users
  52.    for shareware is a distribution charge only);
  53. b) You credit Metropolis Software House as the publisher of the Software in
  54.    all catalogue descriptions and any other written descriptions;
  55. c) You sell the Software for less that $10, and only sell the most current
  56.    version of it;
  57. d) If you want, you may include your own installation routines with the
  58.    Software;
  59. e) Other than installation routines, no other programs may be included on
  60.    the floppy disk that contains the Software, i.e. no bundling or multi-
  61.    program diskettes;
  62. f) No files are modified or deleted.

  65. │ 3. CD-Roms and multi-disk packs: │

  68. You may commercially distribute the Software on a CD-Rom or a pack of several
  69. disks (through mail-order, wholesale, retail, or any other channels), as long
  70. as following conditions are met:
  71.  
  72. a) You explain the shareware concept and describe the Software as shareware;
  73. b) You credit Metropolis Software House as the publisher of the Software in
  74.    all catalogues and the Software descriptions;
  75. c) The front-cover packaging must contain the word "Shareware";
  76. d) The name "Metropolis", as well as the name of the Software must appear on
  77.    the front-cover packaging;
  78. e) No files may be modified or deleted;
  79. f) You must send us a copy of the CD-Rom or the multi-disk package as soon as
  80.    it has been manufactured.

  84. │ 4. Any distribution in a retail environment: │

  87. Any party wishing to sell Metropolis products in a retail environment must
  88. meet all of the above conditions that apply, in addition to the following:
  89.  
  90. a) The following must be included in large type on the front cover of all
  91.    packaging:  The name "Metropolis Software House", the name of the Software,
  92.    and the word "Shareware";
  93. b) You must send us a copy of your packaging as soon as the packaging has been
  94.    manufactured.

  97. │ 5. Bundling with hardware: │

  100. You may bundle the Software with new hardware (computers, sound cards, etc.)
  101. as long as you do not modify or delete any Software files, and as long as you
  102. provide the shareware programs free of charge (i.e. at no additional cost) to
  103. the user when the hardware is purchased.

  105. If you'd like more information about OEM and hardware bundling opportunities,
  106. please contact us. We would welcome the opportunity to work with hardware
  107. manufacturers and resellers.

  110. │ 6. Other distribution opportunities: │

  113. Please contact us if you would like to distribute Metropolis software in a new
  114. and unique way.  We are open to suggestions, and we appreciate new and unique
  115. forms of distribution as a way of reaching new customers.

  118. │ 7. Violation of the agreement: │

  120.  
  121. You may distribute the Software in other ways than those described in this
  122. agreement only with express, written permissiom given by Metropolis.

  124. If you distribute the Software in violation of the terms of this agreement,
  125. you are liable to Metropolis for damages of not less than $1 per copy
  126. distributed or the registration fee, whichever is greater.

  131. │ II. OTHER TERMS AND CONDITIONS: │

  134. a) Ownership: Metropolis has and reserve the exclusive copyright and all other
  135.    rights, title and interest to distribute the Software;
  136. b) Current version: All previous versions of the Software have been withdrawn
  137.    from shareware. This version replaces any previous versions;
  138. c) Your right to distribute under this license is personal, and does not
  139.    include any right to sublicense the Software;
  140. d) THE SOFTWARE IS PROVIDED "AS-IS". NO WARRANTIES OF ANY KIND, EXPRESS OR
  141.    IMPLIED, ARE MADE AS TO IT OR ANY MEDIUM IT MAY BE ON. WE WILL PROVIDE NO
  142.    REMEDY FOR INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES ARISING
  143.    FROM IT, INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR BREACH OF
  144.    WARRANTY OR CONTRACT, EVEN AFTER NOTICE OF THE POSSIBILITY OF SUCH DAMAGES;
  145. e) Term: This License may be terminated by Metropolis by giving a 30 day
  146.    advance written notice;
  147. f) With respect to every matter arising under this License, you consent to the
  148.    exclusive jurisdiction and venue of Polish courts, and to service by
  149.    certified mail, return receipt requested, or as otherwise permitted by law.
