  2. GRANT: You are granted the right to make and to
  3. use unlimited copies of the SHAREWARE version of
  4. the software, however you may NOT distribute your
  5. Registered name and Magic Code which converts the
  6. shareware version to the registered version.

  8. SALE: This software is provided as SHAREWARE and
  9. cannot be sold. This restriction does not apply to
  10. connect time charges, or flat rate
  11. connection/download fees for electronic bulletin
  12. board services. This software can not be bundled
  13. with any commercial package or distributed by
  14. itself or accompanying books or magazines,
  15. including shareware CD-ROMs, without express
  16. written permission from the author.

  18. RESTRICTIONS: You may not: modify, translate,
  19. reverse engineer, decompile, disassemble, or
  20. create derivative works based on the Software.
  21. This includes, but is not limited to, modifying
  22. any graphics, icons, menus, or other displays
  23. associated with the package. You may not remove
  24. any proprietary notices or labels on the Software.

  26. TITLE: Title, ownership rights, and intellectual
  27. property rights in and to the Software shall
  28. remain in Digital Sheep and its suppliers or
  29. licensors. The Software is protected by
  30. international copyright treaties.

  32. DISCLAIMER OF WARRANTY: The Software is provided
  33. on an "AS IS" basis, without warranty of any kind,
  34. including without limitation the warranties of
  35. merchantability, fitness for a particular purpose
  36. and non-infringement. The entire risk as to the
  37. quality and performance of the Software is borne
  38. by you. Should the Software prove defective, you
  39. and not Digital Sheep assume the entire cost of
  40. any service and repair.

  42. LIMITATION OF LIABILITY: UNDER NO CIRCUMSTANCES
  43. AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR
  44. OTHERWISE, SHALL DIGITAL SHEEP OR ITS LICENSORS,
  45. SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY
  46. OTHER PERSON FOR ANY INDIRECT, SPECIAL,
  47. INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY
  48. CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES
  49. FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER
  50. FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER
  51. COMMERCIAL DAMAGES OR LOSSES. THIS SOFTWARE IS NOT
  52. DESIGNED OR INTENDED FOR USE OR RESALE AS ON-LINE
  53. CONTROL EQUIPMENT IN HAZARDOUS ENVIRONMENTS
  54. REQUIRING FAIL-SAFE PERFORMANCE, SUCH AS IN THE
  55. OPERATION OF NUCLEAR FACILITIES, AIRCRAFT
  56. NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC
  57. CONTROL, DIRECT LIFE SUPPORT MACHINES, OR WEAPONS
  58. SYSTEMS, IN WHICH THE FAILURE OF THE SOFTWARE
  59. COULD LEAD DIRECTLY TO DEATH, PERSONAL INJURY, OR
  60. SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE ("HIGH
  61. RISK ACTIVITIES"). DIGITAL SHEEP SPECIFICALLY
  62. DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTY OF
  63. FITNESS FOR
  64. HIGH RISK ACTIVITIES.

  66. TERMINATION: This license will terminate
  67. automatically if you fail to comply with the
  68. limitations described above. On termination, you
  69. must destroy all copies of the Software.
  70.  
  71. MISCELLANEOUS: This Agreement represents the
  72. complete agreement concerning this license between
  73. the parties and supersedes all prior agreements
  74. and representations between them. It may be
  75. amended only by a writing executed by both
  76. parties. If any provision of this Agreement is
  77. held to be unenforceable for any reason, such
  78. provision shall be reformed only to the extent
  79. necessary to make it enforceable.

  81. U.S. GOVERNMENT RESTRICTED RIGHTS: Use,
  82. duplication or disclosure by the Government is
  83. subject to restrictions set forth in subparagraphs
  84. (a) through (d) of the Commercial Computer-
  85. Restricted Rights clause at FAR 52.227-19 when
  86. applicable, or in subparagraph (c) (1) (ii) of the
  87. Rights in Technical Data and Computer Software
  88. clause in DFARS 252.227-7013, and in similar
  89. clauses in the NASA FAR Supplement.
