NOTICE
CRYO ON LINE is the owner and has exclusive rights to the software SCOL VOY@GER P10 V3.x (the Software) which allows the use and the running of applications and/or Internet sites developed with the CRYO ON LINE computer language and can be used on a PC 486 DX33 or further, equipped with Windows 95⌐ OS* or further version or Windows NT 4.0⌐ OS* or further version. (* Operating System). The Software is protected inter alia by the provisions of the French Intellectual Property Code and international conventions relative to copyright. CRYO ON LINE grants you a personal, limited, non exclusive and royalty-free licence to use one copy of the executable code of this Software.
You assume entire responsibility for selection of this Software to achieve your intended results, for its installation, use and results obtained from the Software. CRYO ON LINE is not obliged to provide maintenance or update of the Software. Any use of the Software indicates your acceptance of these terms, both for the Software provided here and for any update and/or maintenance to this Software which would be supplied by CRYO ON LINE.
YOU MAY
- use the Software only for your personal use;
- install and use the Software only on your single micro computer;
- treat the Software like any other copyrighted product (eg. a book) except that you may make a copy (only one) of the Software for backup or archival purposes as long as (a) you reproduce the CRYO ON LINE copyright notice on the copy and (b) you do not otherwise use the copy ;
- transfer the software from one microcomputer to an other provided that no copy remains on the first microcomputer ;
YOU MAY NOT
- copy the Software to, or install the Software on, a network, multiple CPU, multiple site arrangement, or any other hardware configuration where the Software is accessible to more than one CPU or to more than one user ;
- make copies of the Software except as provided above ;
- make modifications and/or alterations in the Software ;
- decompile, disassemble, translate, convert to another programming language or otherwise reverse engineer the Software to the extent that this restriction is expressly prohibited by applicable law. In this respect, you expressly recognise that CRYO ON LINE will have the rights to intervene on the software to correct, adapt and modify it.
- sublicense, lease, sell, assign, export, transfer the Software in whole or in part, directly or indirectly.
YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER THE SOFTWARE OR ANY COPY THEREOF, IN WHOLE OR IN PART, EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS LICENSE.
EXCLUDED WARRANTY
AS A FREEWARE, THIS SOFTWARE IS PROVIDED "AS IS " WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRYO ON LINE FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT.
THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
IN NO EVENT, SHALL CRYO ON LINE OR ITS SUPPLIERS BE LIABLE FOR ANY COMPENSATORY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WIHTOUT LIMITATIONS, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR INABILITY TO USE THE SOFTWARE, EVEN IF CRYO ON LINE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
BECAUSE SOME STATES/JURIDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
TERMINATION
IF YOU VIOLATE ANY TERMS OF THE LICENSE, YOUR LICENSE WILL BE TERMINATED. In this case, you should immediately destroy the Software installed on your computer as well as any copy that might have been made. Otherwise it could, in particular, be an infringment of copyright.
GENERAL
In reference to the French law " informatique et libertΘ " n░78-17 dating from 01/06/1978, you are allowed to access, modify and have an opposition over the data concerning yourself.

This Agreement constitutes the complete and exclusive Agreement between CRYO ON LINE and you with respect to the subject matter hereof. This Agreement may not be modified unless previously agreed in writing between parties. This Agreement shall be governed by the French laws and you expressly agree that any (dispute) not settled out of court will be submitted to the jurisdiction of the Paris Court, unless you may benefit from other jurisdiction applicable law. If a provision of this Agreement is deemed null and void, invalid or without effect, the other remaining dispositions will be valid. All questions about this Agreement and the Software should be directed in writing to CRYO ON LINE, 44-50 avenue du Capitaine Glarner - 93585 St Ouen - FRANCE.
NOTHING IN THE PRESENT CONTRACT SHALL AFFECT THE LEGAL RIGHTS THAT ARE YOURS PURSUANT TO THE APPLICABLE LAWS AND REGULATION, IF YOU ARE A CONSUMER.

Ce Logiciel est notamment protΘgΘ par les dispositions du Code de la PropriΘtΘ Intellectuelle franτais et par les conventions internationales sur le droit d'auteur. CRYO ON LINE vous accorde un droit, personnel, non exclusif et gratuit d'utiliser une copie du code exΘcutable de ce Logiciel.

VOUS POUVEZ
- utiliser ce Logiciel uniquement pour votre utilisation personnelle ;
- installer et utiliser le Logiciel uniquement sur votre micro-ordinateur ;
- utiliser le Logiciel comme tout autre produit protΘgΘ par le droit d'auteur (par exemple : un livre). Vous ne pouvez effectuer qu'une copie de sauvegarde du Logiciel sous rΘserve que (a) vous reproduisiez sur la copie la mention du nom de CRYO ON LINE et (b) vous n'utilisiez pas autrement que pour des raisons de sauvegarde la copie effectuΘe :
- transfΘrer le Logiciel d'un micro-ordinateur α un autre sous rΘserve de ne pas conserver de copie du Logiciel sur le premier ordinateur.
VOUS NE POUVEZ PAS
- copier et/ou installer le Logiciel en rΘseau, sur plusieurs unitΘs centrales de traitement, plusieurs sites et/ou sur toute configuration matΘrielle sur laquelle le Logiciel pourrait Ωtre accessible sur plus d'une unitΘ centrale de traitement ou par plus d'un utilisateur;
- effectuer des copies du Logiciel autres que celle prΘvue ci-dessus;
- modifier et/ou altΘrer le Logiciel ;
- dΘcompiler, dΘsassembler, traduire, convertir dans un autre langage de programmation ou plus gΘnΘralement effectuer des opΘrations de "reverse engineering" (opΘration d'ingΘnierie inversΘe) sur le Logiciel sous rΘserve que cette restriction ne soit pas expressΘment interdite par la loi applicable. A cet Θgard, vous reconnaissez expressΘment α CRYO ON LINE le seul droit d'intervenir sur le Logiciel pour le corriger, l'adapter et le modifier.
- sous licencier, louer, vendre, cΘder, exporter, transfΘrer tout ou partie du Logiciel, directement ou indirectement.
VOUS NE POUVEZ PAS UTILISER, COPIER, MODIFIER OU TRANSFERER TOUT OU PARTIE DU LOGICIEL OU SA COPIE A D'AUTRES FINS QUE CELLES AUTORISEES PAR LA PRESENTE LICENCE.
EXONERATION DE RESPONSABILITE
S'AGISSANT D'UN LOGICIEL FOURNI GRATUITEMENT, LE LOGICIEL EST FOURNI " COMME TEL " (OU EN L'ETAT) SANS AUCUNE GARANTIE. SOUS RESERVE DES DISPOSITIONS CONTRAIRES A TOUTE LOI QUI SERAIT APPLICABLE, CRYO ON LINE S'EXONERE DE TOUTE GARANTIE, INCLUANT, SANS QUE CETTE ENUMERATION SOIT LIMITATIVE, TOUTE GARANTIE CONCERNANT LA CONFORMITE DU LOGICIEL A VOS BESOINS PARTICULIERS ET L'ABSENCE D'ATTEINTE AUX DROITS DES TIERS.
SOUS RESERVE DES DISPOSITIONS CONTRAIRES A TOUTE LOI QUI SERAIT APPLICABLE, IL EST DE VOTRE RESPONSABILITE DE SUPPORTER LES RISQUES LIES A L'UTILISATION ET AUX PERFORMANCES ATTENDUES DU LOGICIEL.
EN AUCUN CAS CRYO ON LINE NE POURRA ETRE CONSIDERE COMME RESPONSABLE DE TOUT TYPE DE DOMMAGE (NOTAMMENT : PERTE DE PROFIT, INTERRUPTION DES RELATIONS D'AFFAIRES, PERTE D'INFORMATIONS PROFESSIONNELLES, IMPOSSIBILITE D'UTILISER LE LOGICIEL) QU'IL SOIT ACCIDENTEL, DIRECT, INDIRECT, SPECIAL, IMPORTANT ET MEME SI CRYO ON LINE A ETE AVERTI DE LA POSSIBILITE D'UN TEL DOMMAGE.
CERTAINES LOIS ET JURIDICTIONS NE RECONNAISSANT PAS L'EXONERATION OU LA LIMITATION DE RESPONSABILITE POUR LES DOMMAGES INDIRECTS, LES DISPOSITIONS SUSVISEES POURRAIENT NE PAS ETRE APPLICABLES.
RESILIATION
SI VOUS NE RESPECTEZ PAS, TOUT OU PARTIE, DES TERMES ET CONDITIONS DE CETTE LICENCE, CETTE DERNIERE SERA RESILIEE. Dans ce cas, vous devrez immΘdiatement detruire le Logiciel installΘ sur votre ordinateur ainsi que la copie que vous auriez effectuΘe. A dΘfaut, vous effectueriez notamment un acte de contrefaτon
DISPOSITIONS GENERALES
ConformΘment aux dispositions de la loi informatique et libertΘ n░78-17 datant du 06/01/1978, vous disposez d'un droit d'accΦs, de rectification et d'opposition sur les donnΘes vous concernant.

Cet Accord ne peut pas Ωtre modifiΘ sans l'accord Θcrit des parties. Ce contrat est rΘgi par le droit franτais et vous acceptez que tout diffΘrend non rΘsolu de maniΦre amiable soit portΘ devant par les tribunaux compΘtents de Paris, sauf disposition contraire de la loi applicable.
Si une clause du prΘsent Accord s'avΘrait non-valide, nulle ou sans effet, les autres dispositions conserveront leur portΘe.
Toutes questions concernant cet Accord et le Logiciel doivent Ωtre adressΘes par Θcrit α CRYO ON LINE, 44-50 avenue du Capitaine Glarner - 93585 St Ouen - FRANCE.
RIEN DANS LA PRESENTE LICENCE N'AFFECTERA LES DROITS AUXQUELS VOUS POURRIEZ PRETENDRE EN VERTU DES LOIS ET REGLEMENTS EN VIGUEUR SI VOUS ETES UN CONSOMMATEUR.
SI VOUS ACCEPTEZ LES CONDITIONS CI-DESSUS, VEUILLEZ CLIQUER SUR L'ICONE " ACCEPTE " (AGREE). AUTREMENT, CLIQUEZ SUR L'ICONE " REFUSE " (DISAGREE).
