  4. This is a license for use of ECONO-SOFT software within your company
  5. or government agency, and is not transferable.  This allows internal
  6. use and copying of the software for as many sites / computers as
  7. contracted for.  Only one set of distribution materials is sent.
  8. Use of the software on a Local Area Network requires a site license
  9. to cover the number of workstations on the network(s).

  44. This is a perpetual license for the use of the software within your company,
  45. and may not be assigned, transferred, or sublicensed to any other party.
  46. This license allows internal use and copying of the software by as many
  47. users/machines as contracted for. Distribution, repackaging, or reselling of
  48. the software, to third parties, is not allowed under this agreement.

  50. Robert K. Blaine dba ECONO-SOFT, the LICENSOR warrants that it is the sole
  51. owner of the software and has full power and authority to grant this license
  52. herein without consent of any other party. Title to the software remains
  53. with Robert K. Blaine dba ECONO-SOFT.

  55. This software and manual are sold "as is" and without warranties as to
  56. performance of merchantability or any other warranties whether expressed or
  57. implied.  In no event shall ECONO-SOFT or Robert K. Blaine be held liable
  58. for any loss of profit or any other commercial damage resulting from the use
  59. or misuse of this product, including but not limited to special, incidental,
  60. consequential or other damages.

  62. Because of the various hardware and software environments into which this
  63. program may be put, no warranty of fitness for a particular purpose is offered.
  64. The user must assume the entire risk of using the program. Any liability of
  65. the seller will be limited exclusively to product replacement or refund of
  66. purchase price.

  68. This agreement shall be construed and enforced in accordance with the
  69. laws of the STATE OF TEXAS.  Any action or proceeding brought by
  70. either party against the other arising out of or related to this
  71. agreement shall be brought only in a STATE or FEDERAL COURT of competent
  72. jurisdiction located in Travis County, Texas.  The parties hereby
  73. consent to in personam jurisdiction of said courts.
