- SAN ANGELO, Texas (UPI) -- An Air Force court-martial deliberated for
- two hours Monday before convicting a former Goodfellow Air Force Base
- commander of four charges linked to pornography.
- Col. James A. Maxwell, Jr., was accused of using his home computer
- to transmit and receive pornographic material, including information
- about gay bars, child pornography, and sexual fantasies about another
- male officer.
- Maxwell, 48, was relieved of command at the San Angelo
- base in June.
- The court, composed of three men and one woman -- all with the rank
- of colonel -- found Maxwell guilty of two counts of transmitting child
- pornography and other obscene material on his home computer.
- The jurors also convicted the Air Force veteran on two counts of
- transmitting indecent language over his computer.
- Maxwell faces a maximum of 14 years in a federal prison, a fine,
- and possible loss of his retirement benefits.
- >From the outset of the trial, Maxwell accused the Air Force of
- destroying his reputation, invading his privacy, and treating him unfairly
- under the law.
- The military judge, Col. Donald E. Weir, rejected a long series of defense
- motions during pre-trial hearings. Among them was one to supress
- information and evidence obtained during a search of Maxwell's home.
- The defense also sought permission to appeal on the point of ``undue
- command influence.''
- Maxwell's military attorneys noted that before their client was
- charged, Air Force Gen. Joseph Ashey had recommended that Maxwell be
- promoted to general officer rank, and recommended him for several
- prestigious honors.
- When the charges were levelled at Maxwell, however, Ashey issued
- an affidavit retracting his recommendations and stating that Maxwell
- was not fit for the service.
- The defense attorney told the judge this action ``heavily influenced
- Maxwell's court-martial,'' and prevented his facing a less consequential
- action.
- The defense asked the judge to dismiss all charges, based on the undue
- command influence motions. That was denied.

- A little background. There was an investigation last year on the
- on-line service, America on Line, concerning the transmittal of
- child porn on that network. According to reports posted on
- that service over the past several months, AOL allowed the FBI
- access to electronic mail and investigated approximately 88 people.
- Maxwell was the only person officially charged.
