- The equal access provisions of the Communication Act certainly *do*
- apply to non-news programming, in fact coverage of candidates in the
- course of legitimate newscasts is exempt from the provision. The
- requirements are triggered only if the candidate appears in person, the
- face or image of the candidate appears, or the voice of the candidate is
- heard. The stations that air such pieces are required to allow opposing
- candidates (if they're legally declared and eligible to take the office)
- an equal *opportunity* to appear in a similar manner and time. Funny
- 'Arsenio' came up. After Clinton appeared on the show, Bush could have
- demanded to appear on the show. Paramount was well aware and ready to
- accomodate him, but they correctly guessed that he had no interest. As
- far as the other shows go, advocacy is allowed. And that certainly
- applies to Rush as well.

- Oh, and by the way, it's the FCC, not the FEC, that has jurisdiction.
