- How does the Student Discipline System Work?
-
- Step 1: Filing a disciplinary charge Disciplinary charges are
- typically filed in two ways: Any individual who feels his or her
- rights as a student may have been violated under the Code on Campus
- Affairs, or that a violation of the Code may have taken place, may
- file a disciplinary report with the Office of Student Judicial
- Affairs. Staff members in the Office of Student Judicial Affairs
- may also present charges for Code violations based on regular
- reviews of local police reports.
-
- Step 2: Conducting an initial review Each alleged Code violation
- is first reviewed by a staff member in the Office of Student Judicial
- Affairs to determine whether there is an apparent violation of the
- Code.
-
- Step 3: Participating in a disciplinary officer hearing When the
- results of the initial review indicate that there has been an
- apparent violation of the Code, the case is reviewed with alleged
- violator referred to as the respondent by a campus disciplinary
- officer. Disciplinary officers are members of the staff of the
- Office of Student Judicial Affairs who are designated by the Senate
- Committee on Student Discipline to hear cases in which the sanctions
- may be less severe than suspension or dismissal from the university.
- The respondent is notified of the disciplinary officer hearing and
- asked to arrange an interview with the disciplinary officer. When
- the respondent arrives at the interview he or she is given time to
- read the case file before meeting with the disciplinary officer to
- present his or her case. When the interview is completed, the
- hearing officer may choose to resolve the case informally, or may
- refer the case to a subcommittee for further hearing. Cases serious
- enough to warrant suspension or dismissal are referred to a
- subcommittee hearing.
-
- Step 4: Participating in a subcommittee hearing There are four
- separate Subcommittees on Student Conduct (undergraduate, graduate,
- law and veterinary medicine). Each subcommittee is made up of
- volunteer faculty and students from those four areas. The respondent
- receives formal notice of a subcommittee hearing by hand-delivered
- or U.S. mail. The respondent must arrange an appointment through
- the Office of Student Judicial Affairs to review the case file,
- discuss the charges with a staff member, and discuss the procedures
- to be followed at the hearing. A hearing date is set at that time.
- At the hearing, the respondent may present his/her case and respond
- to all information provided to the subcommittee. The respondent
- may also have an adviser (typically a friend, teacher, counselor,
- staff member or lawyer) present and may call witnesses to testify
- on his/her behalf.
-
- Step 5: Sanctioning violations The subcommittee is authorized to
- deliver sanctions to students whose cases have been found in
- violation of the Code. After deliberation, the respondent is informed
- of the subcommittees decision and of the sanctions. At that time,
- the respondent also is advised of his/her rights to appeal the
- subcommittees ruling.
-
- Step 6: Appealing the subcommittees ruling Written requests for
- appeals to the Senate Committee on Student Discipline must be
- submitted within five calendar days of notification of the
- subcommittees ruling. Respondents may request an appeal for one or
- more of the following reasons Whether the incident constituted a
- violation of university regulations Whether the hearing procedures
- were followed Whether the action taken was authorized Whether the
- sanction given was warranted
