- Last semester, I wondered why the UC Berkeley Schedule of Classes was not
- available on the Internet. I knew that it was kept at jasper.berkeley.edu,
- which is already on the net. I asked the Office of the Registrar if they
- could mail me a copy so I could put it up for ftp. It would have taken a
- system administrator less than one minute to type the required command:
- mail hh@soda < socfile. They told me they could not do this. I decided to
- do it myself. I acquired the Schedule of Classes through one of the Infocal
- terminals in Sproul Hall. I unplugged the terminal and plugged in my
- PowerBook. I used a terminal emulator on the PowerBook, and performed a
- Search for Class by Name. I selected "start ascii text capture" and
- searched for *. Two hours later, I had the Spring 93 Schedule of Classes on
- my PowerBook's hard disk.

- I posted an anouncement of the on-line availability of the Schedule of
- Classes to several newsgroups. This announcement is still available for
- anon ftp from soda in /classes/statement.

- The Office of the Registrar did not like what I did, and the week before the
- Spring Semester started I received the following letter from the Office of
- Student Conduct:

- I have been asked to investigate a possible violation on your part of the
- following section of the Berkeley Code of Student Conduct (CSC):

- Section I. B. 4 (Unauthorized use of University Computer Equipment)

- 4. Unauthorized entry to or use of University property, equipment, or
- resources. This section includes all forms of misuse of University
- equipment involving electronic or computerized information storage.

- A copy of the Berkeley Code of Student Conduct is enclosed for your
- information.

- This investigation is based on your reported misuse of a University computer
- terminal in Sproul Hall during the 1992 Fall Semester.

- It is necessary that I meet with you in my office on Thursday, January 21,
- 1993, at 12:00 Noon to discuss your case. Please contact my office at
- 643-9069, as soon as possible to confirm your appointment. Please be
- advised that your failure to make that appointment will result in your being
- dropped from the rolls of currently registered students.

- Be advised that under Section III. L. of the Berkeley Code Of Student
- Conduct, a student may be represented by legal counsel or other
- representative at any stage of University disciplinary proceedings.

- LaVerne Lazzereschi had complained to the Office of Student Conduct that I
- had "misused" University computer equipment.

- I talked with Mr. Paganucci in his office today at 10:00. The discussion
- was brief. He told me that unplugging terminals is misuse of equipment. He
- told me that he is giving me an informal warning. He made me state that I
- did not intend to unplug terminals or "misuse" equipment again.

- I stated to him that I will never again "misuse" computer equipment in order
- to acquire public information in electronic form.

- I believe that computers exist to provide access to information. Using a
- computer to give me this access can never be misuse.
