  27. No.  Software doesn't just "fall under the GPL", it has to be put
  28. there. I suspect that if I modify gcc and distribute it without all the
  29. GPL notices, you don't have the right to redistribute what I've done
  30. just because you've noticed it.  You'll have to sue me for distributing
  31. it illegally under copyright law, and try and get the court to rule that
  32. I must GPL my software as a result.  It could decide that I have the
  33. option to withdraw it.  Or any such thing.

  35. In the situation you describe, you won't be able to make your case
  36. because I need only produce a copy of B and claim I took my source from
  37. that and you won't be able to prove otherwise.

  40. guess based on the demonstrably false assumption that there is some
  41. logic to the way Law works.
