- "Publication" is defined in the Copyright Act of 1976 as
- the distribution of copies or phonrecords of a work
- to the public by sale or other transfer of ownership,
- or by rental, lease, or lending.

- So, at least for works after the effective date of the Act, the "Websters"
- (which one, since there are a number of dictionary comapnies that use the
- name Webster) doesn't have any authority.

- As to what is publication before the Act, a definition might be found in
- the prior (1909) copyright act, since it depended highly on publication,
- or in the case law of the appropriate jurisdiction. (That might not be
- California, depending on the choice of law section of the license for
- 32V.)
