  26. "Publication" is defined in the Copyright Act of 1976 as
  27.     the distribution of copies or phonrecords of a work
  28.     to the public by sale or other transfer of ownership,
  29.     or by rental, lease, or lending.

  31. So, at least for works after the effective date of the Act, the "Websters"
  32. (which one, since there are a number of dictionary comapnies that use the
  33. name Webster) doesn't have any authority.

  35. As to what is publication before the Act, a definition might be found in
  36. the prior (1909) copyright act, since it depended highly on publication,
  37. or in the case law of the appropriate jurisdiction.  (That might not be
  38. California, depending on the choice of law section of the license for
  39. 32V.)
