- As a response to the many inquiries Coast Personnel Services Ltd. has
- received requesting information regarding student relocation and employment
- in Canada, the following is provided with the permission of Canada
- Employment and Immigration. (It is taken from policy, not from the Act.
- For more information, consult the Immigration Act and Regulations.)

- 3) Exemption Codes
-
- The validation exemption codes E06, E07 and E08 are used for certain
- student employment situations. The authorizations may only be used in
- Canada to students enrolled in full-time studies or to their spouses.
- Possible employment pursuant to these exemption codes will not be taken
- into consideration when assessing a student applicant's financial position.
- Persons eligible under these codes will be required to pay IMM 1102
- processing fees, unless they come within the exempted catatgories in IS
- Chapter 27. A form letter has been developed to indicate to employers that
- the applicant is eligible to seek employment (IS 15 appendix H).

- a) Code E06
-
- Persons who are full-time, post secondary students and wish to
- engage in employment on the campus of the post-secondary they are
- attending. The employer can be the post-secondary institution,
- faculty, student organization, or private contractor providing
- services to the institution (e.g., catering company) operating on
- the campus.

- b) Code E07
-
- Spouses of foreign students may accept employment in the general
- labour market, provided they are able to provide evidence that:
-
- i) they meet the definition of spouse in Regulation 2; and
-
- ii) they are the spouse of a holder of a student authorization issued
- in accordance with the Regulation 17 and the student is attending a
- post- secondary institution on a full time basis, or the student is
- employed pursuant to E08. Extensions beyond the validity of either
- the student authorization or the E08 employment authorization are
- not possible.

- Spousal employment in this context is intended for spouses who are
- not full-time students themselves.

- c) Code E08
-
- Students may accept education-related employment for up to a
- maximum of one year following the successful completion of their
- studies. This policy is intended to enable students to acquire
- experience outside the classroom and to help broaden the student's
- knowledge and appreciation of Canada's industrial and technological
- capacity.

- To qualify for employment under this code students must meet the
- following criteria:
-
- i) they must provide evidence of successful completion of a program at
- a post-secondary institution, showing the course fully completed;
-
- ii) employment must commence within sixty (60) days of release of final
- marks by the institution where the student is registered,
- indicating that the requirements for a degree or diploma have been
- met. The employment must be consistent with the student's area of
- study and of a type for which Canadian graduates in the same course
- of study would normally be recruited (e.g. the employment accepted
- must require the level of training the foreign student has
- achieved). Extensions beyond one (1) year require an EMP 5056,
- unless the employment falls within another validation exemption
- category;

- iii) the foreign students must apply for the IMM 1102 while their IMM
- 1208 is still valid. Therefore, CICs should ensure that students
- who intend to apply for postgraduation employment are issued IMM
- 1208s which extend 60 days beyond completion of their course of
- studies; and
-
- iv) the employment may involve one or more employers, but may not
- exceed a total of one year. Students are entitled to benefit from
- this option only once.

- Students should be strongly counselled regarding the non extendable
- 1 year limitation of this validation code. It is expected that
- students will advise any prospective employer of this time
- limitation. A letter, similar to that which appears in Appendix J,
- should be sent to the employer so that he is fully aware of the
- implications of hiring foreign students under this exemption. A
- note should also be placed in the Remarks box of the employment
- authorization which states "Employment authorized for a maximum
- period of one year. No extensions shall be granted under this
- validation exemption code."

- CIDA sponsored students are also eligible to apply for employment
- for one year following completion of studies. However, in addition
- to complying with the above criteria, CIDA students must also
- obtain an approval letter from that agency in order to be
- authorized to accept post graduation employment in Canada. This
- requirement is based on the fact that the majority of these
- students are in Canada under employment projects which are governed
- by agreements between Canada and recipient countries (or
- international agencies) stipulating that they must return to their
- home country immediately after completion of their education or
- training programs.
