  53.  The Indonesian Government permitted representatives of the
  54. International Committee of the Red Cross (ICRC) to visit Xanana
  55. Gusmao at an unspecified location in Jakarta on 7 December 1992. He
  56. had been held incommunicado for 17 days before the visit, and there
  57. were fears for his safety. At least 39 others, and possibly many more,
  58. detained in East Timor since early November, have yet to be visited
  59. by the ICRC. They are being held in incommunicado custody and
  60. some are reported to have been subjected to severe forms of torture.

  62. ICRC officials confirmed on 8 December that they had visited Xanana
  63. Gusmao in Jakarta. A report of the visit will be submitted to the
  64. Government of Indonesia but, in accordance with ICRC policy, it will
  65. not be published. The authorities have reportedly promised further
  66. ICRC visits to Xanana Gusmao but the timing of the visits has yet to
  67. be negotiated.

  69. Amnesty International welcomes the ICRC visit, but notes with serious
  70. concern that it occurred 17 days after Xanana Gusmao's arrest, during
  71. which time he may have been subjected to physical and mental torture
  72. and ill- treatment. Amnesty International believes that it is essential
  73. for ICRC representatives, independent lawyers and relatives to be
  74. granted frequent, regular access to Xanana Gusmao, if his safety is to
  75. be effectively guaranteed while he is in custody.

  77. Those still held incommunicado in East Timor include at least 19 close
  78. associates or relatives of Xanana Gusmao, arrested after his capture on
  79. 20 November; and at least 20 others, arrested prior to and during the
  80. anniversary of the November 1991 Santa Cruz massacre (see UA
  81. 367/92, ASA 21/18/92, of 23 November 1992 and follow ups). All are
  82. at risk of torture and ill-treatment and there is urgent concern for
  83. their safety. The ICRC is seeking to be permitted to visit the Dili
  84. detainees in the near future, but it is not known when the visits will
  85. take place.

  87. One of the detainees, Jorge Manuel Araujo Serrano, is reported to
  88. have died under torture and two of the women have reportedly been
  89. raped by Indonesian soldiers (see ASA 21/23/92 of 4 December 1992).
  90. Others are feared to have "disappeared". Amnesty International calls
  91. upon the Indonesian authorities to act immediately to clarify the fate
  92. and whereabouts of these detainees and to allow ICRC officials,
  93. independent lawyers and relatives immediate access to their place of
  94. detention.

  96. FURTHER RECOMMENDED ACTION: Please send
  97. telegrams/telexes/faxes/express and airmail letters in English or your
  98. own language:

  100. - welcoming the fact that the ICRC has been permitted to visit
  101. Xanana Gusmao in detention, but noting with concern that the visit
  102. occurred after 17 days of incommunicado detention;
  103.  
  104. - urging the government to allow the ICRC, independent lawyers,
  105. doctors and relatives frequent, regular access to Xanana Gusmao in
  106. detention;
  107.  
  108. - seeking clarification of the precise whereabouts of Xanana Gusmao;
  109.  
  110. - expressing urgent concern for the safety of the 39 others arrested
  111. since early November, and of all political detainees in East Timor;
  112. calling on the government to permit ICRC representatives, independent
  113. lawyers, doctors and relatives immediate access to their place of
  114. detention;
  115.  
  116. - calling on the government to release all those detained solely for
  117. peaceful political views, or for association with Xanana Gusmao's
  118. family.
