- Possibly, though it isn't clear whether the clause means that (a) the
- Congress may establish the new position and the qualifications for it,
- or just (b) the Congress may establish the position but the same old
- Article III, Section 2, 2d paragraph qualifications -- Presidential
- nomination plus Senate approval -- would apply.

- Based on the wording of the paragraph, I'd suspect the latter, though
- the final decision would, of course, be up to that famous Committee of
- Nine Politically Appointed Lawyers in Washington.
