- Few years back I did some scuba diving off Cabo San Lucas. The
- Colorado divemaster who put the trip together made it very clear
- that US liability practices didn't hold in Cabo. Even though a
- local dive shop provided the boats and guides, if there were any
- accidents we could take no legal action against them. In fact,
- we, the divers, could be sued by the locals for "misrepresenting
- our skill level" and damaging the shop's reputation. This
- concept of "personal responsibility in action" didn't sit too
- well with some members of the group.

- Small companies might be able to sue, even here, but large
- companies that need to maintain a positive public image, like
- Amtrak, almost never seek to recover damages from injured
- parties - the P.R. costs are too high. The closest you'll get to
- that would be the utilities that go after contractors who sever
- buried cables or pipelines. In those cases there is (usually) a
- service outage, so the utility gets to be a hero by restoring
- service quickly. Hard to look like a hero, even when you're in
- the right, if it's your 100-ton loco plowing into a 2-ton
- idiot container.
