- "The Montana Supreme Court has upheld the drunken driving arrest of a man
- who was stopped while pushing his diabled motorcycle down a street.
- Although the MAN was not driving the bike and its engine was not
- operating, he was in control of the vehicle and subject to the law
- requiring motorists to submit to a breath test, the court said in its
- unanimous ruling.
- MAN, 36, was on his way home from a bar in Lewiston last Sept. 19,
- and pushing a motorcycle with a broken clutch when he was arrested.
- He did not get on the bike or start the engine, but did turn on the
- headlight, the court said.
- A police officer said he refused to take a breath test by only blowing
- half-heartedly into the machine. His license was suspended for three
- months."
