- The following articles are taken from the FAA newsletter sent out by
- Flight Standards in Oke City. I've ignored articles of little likely
- interest to non-examiners, and occasionally exercised a light editor's
- hand on the text I did copy.

- Where I've inserted editorial comments they are enclosed in [square
- brackets] and marked with my initials -- jcm. Any other comments
- were part of the FAA newsletter.

- The FAA publishes this material as guidance to designated examiners, and
- to provide insight into how Flight Standards (AFS) views some situations
- which occur in the field. I'm posting them because of the number of
- times I've seen discussions in the rec.aviation newsgroups asking
- some of the same questions which are addressed in the newsletters.
- The recent thread about how a holder of a non-US pilot license can get
- a US certificate is an example: that subject is covered in the newsletter
- from which the articles here were copied.

- Super Instructor Rides Again
-
- In the March 1992 issue of the Examiner Update, we discussed the requirements
- for a flight instructor applicant to receive instruction from an instructor
- who has held a flight instructor certificate for two years and who has
- given at least 200 hours of instruction as a certificated flight instructor.
- An instructor who meets these requirements in the vernacular, a "super
- instructor".

- Questions continue to arise about this requirement. FAR Part 61.187
- requires, in part, that certain instruction be given by a "super
- instructor." The question now comes up as to whether or not a non-super
- instructor may also give instruction in the items required by FAR Part
- 6 1.187. An instructor who does not meet the super instructor requirements
- may certainly give instruction on those items in FAR Part 61.187. There
- is nothing wrong with this. However, it does not relieve the super
- instructor from the requirement that he/she give instruction in ALL
- requirements of FAR Part 61.187. This regulation does not specify a
- minimum amount of time the super instructor must give, but it requires,
- among other things that super instructor give instruction in "performance
- and analysis of standard flight training procedures and maneuvers
- appropriate to the rating sought." For an instructor certificate with
- an AIRPLANE SINGLE ENGINE rating this means all the tasks in the
- Recreational Pilot, Private Pilot, Commercial Pilot, and Flight Instructor
- Practical Test Standards. This is going to take considerable time.
- Even though the regulations do not specify a minimum amount of time
- to be given by super instructor it certainly is not going to be
- accomplished in one or two flights.

- Remember too, that this requirement is for the original issuance of a
- flight instructor certificate. A non-super instructor may give all
- instruction and recommend an applicant for any additional flight
- instructor rating.

- Remember also, that a super instructor is the only person who may
- recommend an applicant for the original issuance of a flight instructor
- certificate.

- Land Somewhere Near the Runway
-
- Several practical Test Standards, in referring to landings, use the
- phrase "...the airplane longitudinal axis aligned with the runway
- centerline." there has been some misunderstanding about the meaning
- of the statement. One person has told us that he reads this to mean
- that on touchdown the longitudinal axis must be parallel to the runway
- centerline and it is OK if the airplane is 500 feet away from the center
- of the runway in an adjacent corn field. Sorry, sports fans, that won't
- fly. The PTS means, ON THE CENTERLINE of the runway. This will be
- changed in the next edition of the affected PTS's to be a little clearer.
- It seems clear enough for a normal person but you know how pilots are.

- U.S. Pilot Certificate Issued on the Basis of a Foreign Pilot License
-
- A foreign pilot may obtain a U.S. pilot certificate or rating on the basis
- of that person's foreign pilot license or rating, if that license or rating
- was issued by a contracting state to the International Civil Aviation
- Organization (ICAO). The initial issuance of a U.S. certificate on the
- basis of a foreign license may not be accomplished by a designated pilot
- examiner, unless specifically authorized.

- A U.S. pilot certificate issued on the basis of a foreign license
- shall state:
-
- VALID ONLY WHEN ACCOMPANIED BY (name of country) PILOT
- LICENSE NO. (number from foreign license). ALL LIMITATIONS
- AND RESTRICTIONS ON THE (name of country) PILOT LICENSE APPLY.

- Additionally, a private pilot certificate issued on the basis of
- a foreign license must include the following:
-
- NOT VALID FOR AGRICULTURAL AIRCRAFT OPERATIONS
-
- The commercial pilot certificate issued on the basis of a foreign license
- must include:
-
- NOT VALID FOR THE CARRIAGE OF PERSONS OR PROPERTY FOR
- COMPENSATION OR HIRE OR FOR AGRICULTURAL OPERATIONS.
-
- The limitation:
-
- NOT VALID FOR FLIGHTS REQUIRING THE USE OF ENGLISH
-
- must be added when appropriate.
-
- A foreign pilot may obtain a standard U.S. certificate or rating, without
- applying on the basis of a foreign license, by passing the *appropriate*
- FAA knowledge and practical tests required by FAR Part 61. The foreign
- pilot license holder is considered to have already met the instructor
- recommendation requirement if that person holds a foreign private or
- commercial pilot license and applies for a U.S. pilot certificate at the
- same or lower level. A holder of a foreign pilot license above the
- commercial level is not eligible for a U.S. pilot certificate higher
- than the commercial level when applying on the basis of a foreign license.

- A foreign pilot may be issued a U.S. instrument rating by passing the
- knowledge test specified by FAR Section 61.75(e). This test is designated
- the Instrument Rating - Foreign Pilot (IFP). A practical test is *not*
- required; therefore, the notation (U.S. TEST PASSED) *is not placed* on
- the person's pilot certificate. However, if the foreign pilot takes
- and passes the full U.S. instrument rating knowledge test, designated
- Instrument Rating - Airplane (IRA) or Instrument Rating - Helicopter (IRH),
- and the U.S. Instrument Rating (Airplane or Helicopter) practical test,
- the notation (U.S. TEST PASSED) *is placed* on the person's U.S. pilot
- certificate that was issued on the basis of the foreign license.

- An FAA Designated Pilot Examiner may administer the practical test required
- for the addition of a rating on a U.S. certificate that was issued on
- the basis of a foreign license. The notation (U.S. TEST PASSED) *must*
- be on the person's pilot certificate that was issued on the basis of a
- foreign license WHENEVER A PRACTICAL TEST IS ADMINISTERED. The addition
- of a multiengine or type rating are examples of this procedure.

- A rating may be added to a standard U.S. pilot certificate when the
- requirements of FAR Part 61 are met. This includes the practical
- tests. However, since the standard U.S. pilot certificate is unrelated
- to a foreign license, there is *no notation* (U.S. TEST PASSED)
- entered on the person's pilot certificate. In other words, DO NOT
- COMBINE any pilot certificate or rating obtained by "standard procedures"
- with any pilot certificate "issued on the basis" of a foreign pilot
- license by entering the notation (U.S. TEST PASSED). When a pilot
- obtains a standard pilot certificate, all ratings with the notation
- (U.S. TEST PASSED) listed on the certificate issued on the basis of
- a foreign license may be added to the standard pilot certificate.
- Ratings without the notation (U.S. TEST PASSED) may not be added. As
- a result, the original certificate issued on the basis of a foreign
- license may have ratings and privileges not listed on the standard
- certificate. To exercise all of the privileges entitled, the pilot must
- continue to hold *both* the original certificate issued on the basis
- of a foreign license and the standard pilot certificate.

- Be sure the temporary certificate issued to the applicant is signed by
- the examiner. If a handwritten temporary is issued to the applicant
- in the field at the time of the flight test and a temporary certificate
- is later typed to forward with the file, this typed original MUST also
- have the examiner's signature, but does not require the applicant's
- signature.

- Be sure the flight instructor's recommendation is not more than 60 days
- old on the date of the practical test.
