- Legal or not, it is a bad idea for several reasons :

- - You increase the risk you will have to shoot
- - If you shoot, the legal system will make a BIG deal out of the fact
- that you placed yourself in an situation which resulted in the
- shooting, and that you could have avoid said situation at no risk of
- personal injury.
- - Even if you don`t shoot (depending on the state) the car thief would
- have assault charges pressed against you for bargaining room (then
- you go out and pay a lawyer...)
- - If you shoot, you will probably be sued.
- - Police have general immunity against suits if they acted on reasonable
- suspicion. In general, citizens have no such immunity (civilly or
- criminally) and are in deep shit if the subject is not indeed guilty
- beyond a reasonable doubt.

- The best position is face down, arms outstreatched, palms up, ankles
- crossed, facing away from captor. (this is NOT advice to try to hold
- someone at gunpoint, just relaying a cop friend's instrucitons on how
- to do it).
