- Though I am not an attorney, I think Glenn Tenney's equating of opportunity
- costs (what something would have cost if you bought it) with financial
- gain may not be what the law means by financial gain.

- I think the law means receiving money, i.e. selling a copy.

- In particular, one might argue that one would not have bought the item
- if he hadn't copied it, so although there is value, and perhaps even
- gain, there isn't FINANCIAL gain.
