- Good question. Pardon me whilst I ramble. I'm no constitutional
- scholar but I play one on TV....

- It's clear they can *restrict* it (cannot be done in the middle of the
- street, no prostitution). And various courts have upheld bans against
- oral sex (sodomy) between consenting hets.

- I suppose *if* one can find no "right" to homosexual sex in the
- constitution *and* one accepts that this means it can be banned then
- one could ban het sex in a similar way....

- An argument that folks should be able to reproduce, even if one could
- massage that out of the constitution in a way that still disallows
