  26. Good question.  Pardon me whilst I ramble.  I'm no constitutional
  27. scholar but I play one on TV....

  29. It's clear they can *restrict* it (cannot be done in the middle of the
  30. street, no prostitution).  And various courts have upheld bans against
  31. oral sex (sodomy) between consenting hets.

  33. I suppose *if* one can find no "right" to homosexual sex in the
  34. constitution *and* one accepts that this means it can be banned then
  35. one could ban het sex in a similar way....

  37. An argument that folks should be able to reproduce, even if one could
  38. massage that out of the constitution in a way that still disallows
  39. homo-sex wouldn't work because one does not *require* sex to
  40. reproduce.  Just a syringe, a petri dish and a few other things....
