- Needham Mass, oct 2 1992 -- brooktrout technology inc, owner
- of a fundamental patent covering "fax on demand" technology,
- reported that it is engaged in legal proceedings involving the
- patent with two manufacturers of fax-on-demand systems.

- a complaint filed by the two manufacturers in the northern california
- federal district court seeks a declaratory judgement to the effect
- that brooktrout's patent is invalid and not infringed by the
- manufacturers. brooktrout had previously offered to license the
- patent to the manufacturers for a royalty.

- brooktrout's president, eric giler, said, "we do not regard this as a
- material development. brooktrout does not depend on patents to sell
- its products, and has not relied on patent licensing as a source of
- revenues. the plaintiffs are seeking to avoid paying license fees
- under the patent, and do not make any claim for damages. we believe
- they are simply trying to take advantage of the declaratory judgement
- mechanism to control the timing and location of legal proceedings.
- regardless of the outcome of the litigation, we do not expect that it
- will have any material effect on the company (brooktrout)."

- brooktrout's patent, issued by the US patent office in 1990, covers
- generally any method for the selection of facsimile messages and their
- deliver to a particular telephone number under control of commands
- entered through a telephone, for example in the form of signals
- generated from the telephone's touch-tone keypad. this method is
- employed in many fax-on-demand systems, which provide business users
- and service providers the ability to offer automated fax delivery of
- specified information in response to requests from customers,
- subscribers or other callers.

- based on the complaint filed in the declaratory judgement action and
- prior communications with plaintiffs, brooktrout understands that they
- will assert that brooktrout's method was anticipated by prior art.
- brooktrout further understands that the litigation is being supported
- by two competitors of brooktrout as well as the named plaintiffs.

- mr. giler said, "brooktrout was a pioneer in developing fax-on-demand
- using modern computer-based fax and voice technologies. these efforts
- resulted in the grant of our patent. we intend to pursue this
- litigation actively to uphold the validity of our patent, although w
- are not able to make any prediction as to the outcome. in the
- meantime, we will continue offering licenses under the patent to
- sellers and users of fax-on-demand systems."
