  26. I believe you're referring to the famous Hardwicke case, famous
  27. because it was appealed to the U.S. Supreme Court, which upheld the
  28. Georgia "sodomy law".  This was one of the crucial decisions that
  29. sets the current state of precedent regarding the concept of "right
  30. to privacy".

  32.    The laws just plain shouldn't be on the books, *IMHO* 
  33.    As the folks who are working to get the Mass laws overturned point
  34.    out, it doesnt do anyone any good to have laws which are not enforced.
  35.    It hurts respect for the law, and it gives the police an arbitrarily
  36.    applicable weapon.

  38. Of course, in the case you cite above, the law *was* enforced.  I
  39. think the problem with the law doesn't so much lie with the question
  40. of how much it's enforced as with the fact that it's just not right.
  41. I wish a strong majority of the electorate agreed with me about that.
