- I'd like some advice about a problem I'm having with a contractor. I live in a
- brick house that needed pointing. A guy who has done some other work for me in
- the past said that I might be able to save some money by slush-pointing the
- house. He said he would try it on a small area of the house and, if it worked,
- do the whole house that way. I have nothing in writing with him, by the way.
- (I know, I know...)

- So he did his experiment, pronounced it a success, covered the side of the
- house with mortar, then came back to me and said that he had been mistaken and
- that there was now no way to get the mortar off the bricks. He would be glad
- to paint the mortar, though, and he was sure it would look great. As you can
- imagine, I was very unhappy. After much wrangling we agreed that he would
- do everything he could to get the mortar off the bricks, but if he failed he
- would point the rest of the house by hand and paint the side with the mortar
- on it, all for the original price of $2000. He also agreed to guarantee the
- paint job for as long as I own the house (which, considering its present
- state, may be a long time!).

- Mistake number two: When he was just about finished with the pointing, he
- asked me for the balance of his payment. He said he would finish the pointing
- the next day and begin the paint job the following week. I believed him and
- gave him the balance. That was about a month ago. Since then, he has promised
- to come out a number of times and not showed; left mortar and other debris all
- around the house and on all the window sills; failed to return many phone
- calls; and failed to respond to my increasingly aggressive threats and
- insinuations.

- Here's what I already know:
- 1) I should have gotten it in writing
- 2) I shouldn't have paid him until he was really finished.

- Here's what I don't know:
- 1) What can I do (if anything) to force him to live up to his part of the
- agreement?
- 2) What can I do if he doesn't?

- I'd greatly appreciate any advice that anyone could give me.
