- My understanding of the situation is that the 'big boys' are rushing
- to get patents to use as 'trading fodder'. E.g. Vendor ABC and
- Vendor DEF (both three-letter computer companies) have cross-licensing
- agreements for each other's patents. If ABC doesn't meet its "quota"
- of new patents, and DEF does, then under the terms of the agreement,
- ABC has to pay more money to DEF for use of DEF's patents.
-
- The main problem with this scenario is that eventually, the few will
- crowd out the many, as the little guys won't have portfolios of
- patents to use in trade. To my way of thinking, this is the greatest
- danger of the entire software patent issue: that it has a substantial
- potential to create monopolies or obligarchies (is that the right term
- for group monopolies?)
