WizGuard Corporation ("WizGuard") grants you a free trial license to use WizGuard Software ("Software") solely for evaluation purpose for a period of fourteen (14) days. You shall not use the Software for any development, commercial or production purpose. You must purchase a full use license by paying the fee to WizGuard if you wish to continue to use the software after the end of the 14-day trial period. Any commercial reproduction or redistribution of the Software is expressly prohibited by law, and may result in severe civil and criminal penalties. Your free trial license is also subject to the terms and conditions of the Full Use License Agreement set forth below.
FULL USE LICENSE AGREEMENT
NOTICE: By downloading the Software, you agree to be bound by the terms of the Full Use License Agreement ("Agreement") which is included with the Software. If you do not agree to these terms, you may not download or use the Software. You will not be able to install the Software that includes the Agreement unless you first accept the terms of the Agreement.
You may use one copy of the Software on only one computer at a time. If you have multiple licenses for the Software, you may use as many copies at any time as you have licenses. "Use" means loaded in temporary memory or permanent storage on the computer.
COPYRIGHT: WizGuard owns the proprietary rights over the Software which is the copyrighted product of WizGuard. You acquire only the right to use the Software and do not acquire any rights of ownership. Copying or downloading of this software for further reproduction or redistribution is expressly prohibited. You may not rent or lease the Software. You shall also not decompile, reverse engineer, or disassemble the Software or otherwise attempt to learn the source code, structure, algorithms or ideas underlying the Software.
WARRANTY DISCLAIMER: WizGuard disclaims all warranties and conditions with regard to the Software, including all implied warranties and conditions of merchantability and/or fitness for a particular purpose. You agree that you accept this license on an "as is" basis without warranty of any kind. WizGuard does not warrant that the functions of the Software will meet your requirements or that operation of the Software will be uninterrupted or err free.
LIMITATION OF LIABILITY: WizGuard's sole liability, and your exclusive remedy, is to refund you for the full purchase price of the Software. In no event shall WizGuard be liable for any damages, including direct or indirect, incidental, special or consequential damages, or any damages whatsoever resulting from loss of use, data, or profits, incurred by you or any third party, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use of the Software. WizGuard shall also not be liable for any damages whatsoever, resulting from loss of use, data, or profits, incurred by you or any third party, due to anyone's intentional or unintentional tampering the Software.
RESTRICTED RIGHTS LEGEND: Any software which is downloaded from this site for or by the United States of America, its agencies and/or instrumentalities (collectively as "US Government") is provided with Restricted Rights. Use, duplication or disclosure by the US Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. US GOVERNMENT EXPORT CONTROLS: By downloading, using or distributing the Software, you represent and warrant that you are not located in or a national or resident of or exporting the Software to any of the following countries: Cuba, Iraq, Libya, North Korea, Iran. Syria, or any other country to which the US has embargoed goods, or that you are not on the US government's Specially Designated Nationals or Table of Deny Orders, or you are not exporting the Software to anyone who is on such list.
TRADEMARKS: WizGuard, BizGuard, Safe and Productive Internet Use are trademarks of WizGuard Corporation. All other brand names or trademarks are the property of their respective owners.
This license is effective until terminated. It will terminate upon your breach of any terms of this license. Upon termination, you agree that the Software and all copies will be destroyed.
You acknowledge that you have read this agreement, you understand it, you agree to be bound by its terms, and that this is the complete and exclusive agreement between you and WizGuard regarding the Software.
