  37. 1. DEFINITIONS
  38.  
  39. "jv16 PowerTools" means the jv16 PowerTools software product
  40.   and everything included in its official distribution
  41.   packages, such as the documentation, all the plug-in
  42.   applications and all the other such modules and applications.
  43.  
  44. "Trial version" means the free, unlicensed and time limited 
  45.   edition of jv16 PowerTools that can freely be downloaded 
  46.   from Macecraft Software's official web site (www.macecraft.com).
  47.  
  48. "official distribution package" means a package file, such as .zip or
  49.   .rar archive or a self extracting ("SFX") version of such archive, or
  50.   an installation program containing jv16 PowerTools which can be
  51.   downloaded from Macecraft Software's official home page www.macecraft.com.
  52.  
  53. "license agreement" means this text document. This license agreement is a
  54.   legal agreement between you (individual or a legal entity) and
  55.   Macecraft Software. You must accept all the terms in this license 
  56.   agreement and the limitations of your current license if you want 
  57.   to use, run, copy or distribute jv16 PowerTools in any ways.
  58.  
  59. "license" means a legal right to use jv16 PowerTools. A license
  60.   must be bought before you are allowed to use jv16 PowerTools more than
  61.   its trial period of 30 days.
  62.  
  63. "Amount of computers this product can be used with" means all kinds of use,
  64.   such as usage over a network connection or usage from a cd-rom or other
  65.   such media with or without actually installing the software to the specific
  66.   computers.

  69. 2. WARNING

  71. jv16 PowerTools is protected by copyright laws and international
  72. copyright treaties as well as other intellectual property laws and
  73. treaties. Unauthorized reproduction or distribution of the
  74. jv16 PowerTools, or any portion of it, may result in severe criminal
  75. and civil penalties, and will be prosecuted to the maximum extent
  76. possible under law.

  79. 3. GRANT OF LICENSE
  80.  
  81. Macecraft Software grants you the following rights provided that you
  82. comply with all terms and conditions of this License Agreement:
  83.  
  84.   1. Usage. You may install, use, access and run jv16 PowerTools
  85.      in so many computers that the license you own allows you to.
  86.  
  87.      Note:
  88.      If you don't know with how many computers your current license 
  89.      allows you to use jv16 PowerTools you can find that out by starting
  90.      jv16 PowerTools and pressing the F2 key from your keyboard.
  91.  
  92.   2. Personal usage. If you, or the company you work for, owns a license 
  93.      for jv16 PowerTools you may, in that case, install, use, 
  94.      access and run jv16 PowerTools in your home computer under the 
  95.      same license. In such case, your home computer must be owned and 
  96.      used only by you or the members of your family.
  97.  
  98.   3. Privacy. Macecraft Software hasn't implemented any mechanism, protocol,
  99.      method or algorithm ("Spyware") to jv16 PowerTools which would collect 
  100.      sensitive information from your computer and then would automatically 
  101.      send the information to  Macecraft Software without your knowledge or 
  102.      permission.
  103.  
  104.   4. Basic security. Macecraft Software hasn't implemented any mechanism, 
  105.      protocol, method or algorithm ("Trojan Horse") which would allow
  106.      Macecraft Software to take full control of your computer without 
  107.      your knowledge or permission.

  111. 4. RESTRICTIONS AND LIMITATIONS OF USE
  112.  
  113. You are NOT allowed to:
  114.  
  115.   1. Modify, reverse engineer, decompile, disassemble or otherwise
  116.      attempt to reconstruct or discover the source code, or any parts
  117.      of it, or discover or reconstruct any mechanism, algorithm or
  118.      a protocol from the binaries of jv16 PowerTools.
  119.  
  120.   2. Reverse engineer or otherwise attempt to reconstruct or 
  121.      discover the source code, or any parts of it, or discover 
  122.      or reconstruct any mechanism, algorithm or a protocol from 
  123.      the jv16 PowerTools by running any kind of special
  124.      monitoring software, such as registry monitoring software, 
  125.      or analysing software, such as "SoftICE" or other such tool.
  126.  
  127.   3. Create, develop, distribute, use, install or store in your
  128.      computer a program, source code, mechanism, method, protocol or
  129.      algorithm to bypass or to brake jv16 PowerTools' security
  130.      features, license validation, license creation, user account
  131.      validation or user account creation routines, methods or algorithms,
  132.      or any parts of them.

  134.   4. Create derivative works based on jv16 PowerTools (e.g. incorporate
  135.      jv16 PowerTools in a commercial product or service without a proper
  136.      license), except that you may create bug fixes and translations.
  137.  
  138.   5. Rent, lease, sublicense, convey, distribute or otherwise
  139.      transfer rights to jv16 PowerTools without a written permission
  140.      from Macecraft Software.
  141.  
  142.   6. Remove any product identification, copyright, proprietary
  143.      notices or labels from jv16 PowerTools.
  144.  
  145.   7. Distribute, re-distribute, rent, lease or sell the licensed
  146.      version of jv16 PowerTools or any portions of it or the license
  147.      itself, the "license.dat" file, or any portions of the 
  148.      license or the "license.dat" file without a written permission
  149.      from Macecraft Software.
  150.  
  151.   8. Sell, re-sell, rent or lease jv16 PowerTools, any portions of it 
  152.      or its license, or any portions  of a license without written
  153.      permission from Macecraft Software.
  154.  
  155.   9. Distribute jv16 PowerTools in any other form than in the
  156.      official distribution packages without a written permission
  157.      from Macecraft Software.
  158.  
  159.   10. Use the licensed version of jv16 PowerTools if you do not
  160.       have a valid license or if you do not know who has bought the 
  161.       license or if you know that the copy you are using is illegal 
  162.       or the license itself is illegal or faked.
  163.  
  164.   11. Use, run, copy, distribute or store jv16 PowerTools in your computer
  165.       if this license agreement is violated in any ways.

  169. 5. TERMINATION OF LICENSE
  170.  
  171. Macecraft Software has the right to terminate this license if you do
  172. not abide by the terms and conditions of this license, in which case 
  173. you must destroy all copies of jv16 PowerTools and all of its 
  174. component parts.

  176.  
  177. 6. MAINTENANCE, SUPPORT AND UPDATES
  178.  
  179. Macecraft Software is under no obligation to maintain, support or
  180. update jv16 PowerTools in any ways, or to provide updates or error
  181. corrections.

  183. However, if you have purchased technical support from Macecraft Software
  184. for this product will Macecraft Software then provide technical assistance 
  185. according to the terms of the contract.

  188. 7. CONFIDENTIALITY
  189.  
  190. Licensed version of jv16 PowerTools and any license authorization
  191. codes (such as the "license.dat" file) are confidential. You agree to take
  192. adequate steps to protect jv16 PowerTools and any license authorization
  193. codes and "license.dat" file from unauthorized disclosure or use.
  194. You agree that you will not disclose the licensed version of
  195. jv16 PowerTools, any parts of it, its license or any parts of the
  196. license to any third party.

  199. 8. DISCLAIMER
  200.  
  201. Macecraft Software expressly disclaims all warranties, whether express, 
  202. implied or statutory, including, without limitation, the implied 
  203. warranties of merchantability, of fitness for a particular purpose, 
  204. noninfringement of third party intellectual property rights, and any 
  205. warranty that may arise by reason of trade usage, custom, or course of 
  206. dealing. Without limiting the foregoing, you acknowledge that 
  207. jv16 PowerTools is provided "as is" and that Macecraft Software 
  208. does not warrant that jv16 PowerTools will run uninterrupted or error 
  209. free nor that jv16 PowerTools will operate with hardware and/or 
  210. software not provided by Macecraft Software. This disclaimer
  211. of warranty constitutes an essential part of the agreement. Some states
  212. do not allow the exclusion of implied  warranties, so the above exclusion
  213. may not apply to you, and you may have other rights, which vary from
  214. state to state.

  217. 9. LIMITED LIABILITY
  218.  
  219. The entire risk as to results and performance of jv16 PowerTools is assumed
  220. by you. Under no circumstances will Macecraft Software or they licensors be liable
  221. for any direct or special, indirect, incidental, exemplary or consequential
  222. damages of any kind or nature whatsoever, whether based on contract,
  223. warranty, tort (including negligence), strict liability or otherwise,
  224. arising out of or in any way related to jv16 PowerTools or this agreement,
  225. even if the Author or his licensors have been advised of the possibility
  226. of such damage or if such damage could have been reasonably foreseen,
  227. and notwithstanding any failure of essential purpose of any exclusive
  228. remedy provided in this agreement. Such limitation on damages includes,
  229. but is not limited to, damages for loss of goodwill, lost profits, loss
  230. of data or software, work stoppage, computer failure or malfunction or
  231. impairment of other goods. In no event will the Author or his licensors
  232. be liable for the costs of procurement of substitute Software or services.
  233. in addition, in no event will the total liability of the Author in connection
  234. with this agreement or jv16 PowerTools exceed the actual amount paid to the
  235. author, if any, for jv16 PowerTools giving rise to the claim. You acknowledge
  236. that jv16 PowerTools is not designed or licensed for use in on-line equipment
  237. in hazardous environments such as operation of nuclear facilities, aircraft
  238. navigation or control, or life-critical applications. The Author expressly
  239. disclaims any liability resulting from use of jv16 PowerTools in any such
  240. on-line equipment in hazardous environments and accepts no liability in
  241. respect of any actions or claims based on the use of jv16 PowerTools in any
  242. such on-line equipment in hazardous environments by you. For purposes of
  243. this paragraph, the term "life-critical application" means an application
  244. in which the functioning or malfunctioning of jv16 PowerTools may result directly
  245. or indirectly in physical injury or loss of human life.

  248. 10. DISTRIBUTING
  249.  
  250. Trial version of jv16 PowerTools may be freely distributed provided
  251. that it is not modified in any ways and that the original distribution packages
  252. remain intact with all accompanying files, and provided that no fee is
  253. charged (except for any reasonable fees necessary to cover costs of
  254. distribution media), and that this license agreement is not violated
  255. in any ways. You are not allowed to include jv16 PowerTools to any
  256. commercial CD-ROM or DVD software collection without a written permission
  257. from Macecraft Software.
  258. Macecraft Software reserves the right to deny you from distributing
  259. jv16 PowerTools even if you haven't violated this license agreement.

  262. 11. RESERVATION OF RIGHTS
  263.  
  264. Macecraft Software reserves all rights not expressly granted to you 
  265. in this license agreement.

  268. YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE
  269. AGREEMENT AND THE LIMITATIONS OF YOUR LICENSE
  270. BY INSTALLING, COPYING, DISTRIBUTING OR OTHERWISE
  271. USING JV16 POWERTOOLS. IF YOU DO NOT AGREE, DO NOT
  272. INSTALL, DISTRIBUTE OR USE JV16 POWERTOOLS IN ANY WAYS.
