  6.         Adabas D End User License Terms
  7.  
  8.  
  9. THE ADABAS D PERSONAL EDITION LICENSE AGREEMENT
  10. (This is a license and not a sale)
  11.  
  12. 1. Software AG grants you a nontransferable and non-exclusive license
  13. to use the enclosed Software AG software program(s) ("Software") and 
  14. its documentation, solely for your own internal data processing and 
  15. computing needs. The Licensee is solely for the use as an intgrated
  16. product of StarOffice.
  17.  
  18. ADABAS D Personal Edition Software is defined as Software which may 
  19. execute on the following platforms, such as, but not limited to: 
  20. Windows 95, Windows 98 and Windows NT 4.0. 
  21. Each ADABAS D Personal Edition Client Software on a multi-user 
  22. computer or a local area network must have a valid license from 
  23. Software AG. 
  24.  
  25. This free Personal Edition of ADABAS D is a single user, non-shared
  26. database use version, and contains the following restrictions:
  27.  
  28.     - No Support
  29.     - Maximum 100 MB database size
  30.     - Maximum of three (3) concurrent sessions
  31.     - No distributed database functionality
  32.  
  33. Software AG does not provide any support for the installation and/or 
  34. usage of this ADABAS D Personal Edition. 
  35.  
  36. 2. You may not sublicense, assign, rent, lease or otherwise convey 
  37. the right to use the Software; any attempt to do so (whether or not 
  38. successful), terminates this license to use the Software without 
  39. refund of any fees paid.
  40.  
  41. 3. Software AG further grants you the right to make a backup archival
  42. copy of the Software as set forth in Paragraph 4. 
  43. You may not decompile, disassemble, reverse engineer, copy, transfer 
  44. or otherwise use the Software except as stated in this Agreement. 
  45. Some documentation for the Software contained in the package may 
  46. be viewable using  a utility called WordView, which is a product 
  47. of Interleaf GmbH. The usage authorization for backup and archival 
  48. copyright notification and restrictions granted for the Software 
  49. also applies to WordView. SOFTWARE AG MAKES NO WARRANTY WHATSOEVER 
  50. AS TO THE WORDVIEW SOFTWARE, WHICH IS PROVIDED "AS IS".

  52. 4. The Software, and its associated Adabas D Personal Edition 
  53. documentation are proprietary products of Software AG and are 
  54. protected by copyright laws and international treaties. 
  55. You must treat the Software like any other copyrighted material, 
  56. except that you may either make copies of the Software for 
  57. backup or archival purposes, or you may place the ADABAS D Server 
  58. Software on a single server and the ADABAS D Client Software on 
  59. a single hard disk for each user provided that you keep the 
  60. Software solely for backup or archival purposes. Copyright laws 
  61. prohibit making additional copies of the Software for any other 
  62. reason. You may not copy the documentation and/or other written 
  63. materials without the written permission of Software AG.

  65. 5. LIMITED WARRANTY/LIMITATION OF REMEDIES: SOFTWARE AG PRODUCTS ARE 
  66. LICENSED "AS IS". SOFTWARE AG MAKES NO WARRANTIES WHATSOEVER, AND 
  67. SUCH WARRANTY IS IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED,
  68. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF 
  69. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO 
  70. THE SOFTWARE AND THE ACCOMPANYING DOCUMENTATION. THE ENTIRE RISK AS 
  71. TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.

  73. IN NO EVENT WILL SOFTWARE AG BE LIABLE TO YOU FOR DIRECT OR INDIRECT 
  74. DAMAGES, INCLUDING ANY LOSS OF PROFITS OR OTHER INCIDENTAL OR 
  75. CONSEQUENTIAL DAMAGES, ARISING OUT OF YOUR USE OF OR INABILITY TO 
  76. USE THE SOFTWARE EVEN IF SOFTWARE AG OR AN AUTHORIZED SOFTWARE 
  77. REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  79. 6. Software AG may terminate this License Agreement in the event 
  80. that Licensee breaches any of the terms and conditions of this 
  81. Agreement and that the breach is not cured within thirty (30) days 
  82. after receipt of written notice of the breach from Software AG. 
  83. Upon receipt of written termination notice, Licensee shall cease 
  84. using the Software.

  86. 7. If any provision of this Agreement shall be unlawful, void, or 
  87. for any reason unenforceable, then that provision shall be deemed 
  88. severable from this Agreement and shall not affect the validity and 
  89. enforceability of the remaining provisions of this Agreement. This 
  90. Agreement is governed by the laws of the Commonwealth of Virginia.
