  2.                     Binary Code License Agreement
  3.  
  4. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED SUPPLEMENTAL LICENSE
  5. TERMS (COLLECTIVELY "AGREEMENT") CAREFULLY BEFORE OPENING THE SOFTWARE
  6. MEDIA PACKAGE.  BY OPENING THE SOFTWARE MEDIA PACKAGE, YOU AGREE TO
  7. THE TERMS OF THIS AGREEMENT.  IF YOU ARE ACCESSING THE SOFTWARE
  8. ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF THESE TERMS BY SELECTING
  9. THE "ACCEPT" BUTTON AT THE END OF THIS AGREEMENT.  IF YOU DO NOT AGREE
  10. TO ALL THESE TERMS, PROMPTLY RETURN THE UNUSED SOFTWARE TO YOUR PLACE
  11. OF PURCHASE FOR A REFUND OR, IF THE SOFTWARE IS ACCESSED
  12. ELECTRONICALLY, SELECT THE "DECLINE" BUTTON AT THE END OF THIS AGREEMENT.
  13.  
  14. 1.  LICENSE TO USE.  Sun grants you a non-exclusive and
  15. non-transferable license for the internal use only of the accompanying
  16. software and documentation and any error corrections provided by Sun
  17. (collectively "Software"), by the number of users and the class of
  18. computer hardware for which the corresponding fee has been paid.
  19.  
  20. 2.  RESTRICTIONS.  Software is confidential and copyrighted. Title to
  21. Software and all associated intellectual property rights is retained
  22. by Sun and/or its licensors.  Except as specifically authorized in any
  23. Supplemental License Terms, you may not make copies of Software, other
  24. than a single copy of Software for archival purposes.  Unless
  25. enforcement is prohibited by applicable law, you may not modify,
  26. decompile, or reverse engineer Software.  You acknowledge that
  27. Software is not designed, licensed or intended for use in the design,
  28. construction, operation or maintenance of any nuclear facility.  Sun
  29. disclaims any express or implied warranty of fitness for such uses.
  30. No right, title or interest in or to any trademark, service mark, logo
  31. or trade name of Sun or its licensors is granted under this Agreement.

  33. 3.  LIMITED WARRANTY.  Sun warrants to you that for a period of ninety
  34. (90) days from the date of purchase, as evidenced by a copy of the
  35. receipt, the media on which Software is furnished (if any) will be
  36. free of defects in materials and workmanship under normal use.  Except
  37. for the foregoing, Software is provided "AS IS".  Your exclusive
  38. remedy and Sun's entire liability under this limited warranty will be
  39. at Sun's option to replace Software media or refund the fee paid for
  40. Software.
  41.  
  42. 4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS AGREEMENT, ALL
  43. EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES,
  44. INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A
  45. PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  46. EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

  48. 5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOT PROHIBITED BY LAW, IN
  49. NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE,
  50. PROFIT OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR
  51. PUNITIVE DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF
  52. LIABILITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE
  53. SOFTWARE, EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  54. DAMAGES.  In no event will Sun's liability to you, whether in
  55. contract, tort (including negligence), or otherwise, exceed the amount
  56. paid by you for Software under this Agreement.  The foregoing
  57. limitations will apply even if the above stated warranty fails of its
  58. essential purpose.
  59.  
  60. 6.  Termination.  This Agreement is effective until terminated.  You
  61. may terminate this Agreement at any time by destroying all copies of
  62. Software.  This Agreement will terminate immediately without notice
  63. from Sun if you fail to comply with any provision of this Agreement.
  64. Upon Termination, you must destroy all copies of Software.
  65.  
  66. 7.  Export Regulations.  All Software and technical data delivered under
  67. this Agreement are subject to US export control laws and may be
  68. subject to export or import regulations in other countries.  You agree
  69. to comply strictly with all such laws and regulations and acknowledge
  70. that you have the responsibility to obtain such licenses to export,
  71. re-export, or import as may be required after delivery to you.

  73. 8.  U.S. Government Restricted Rights.  If Software is being acquired
  74. by or on behalf of the U.S. Government or by a U.S.  Government prime
  75. contractor or subcontractor (at any tier), then the Government's
  76. rights in Software and accompanying documentation will be only as set
  77. forth in this Agreement; this is in accordance with 48 CFR 227.7201
  78. through 227.7202-4 (for Department of Defense (DOD) acquisitions) and
  79. with 48 CFR 2.101 and 12.212 (for non-DOD acquisitions).
  80.  
  81. 9.  Governing Law.  Any action related to this Agreement will be
  82. governed by California law and controlling U.S. federal law.  No
  83. choice of law rules of any jurisdiction will apply.
  84.  
  85. 10.  Severability.  If any provision of this Agreement is held to be
  86. unenforceable, this Agreement will remain in effect with the provision
  87. omitted, unless omission would frustrate the intent of the parties, in
  88. which case this Agreement will immediately terminate.
  89.  
  90. 11.  Integration.  This Agreement is the entire agreement between you
  91. and Sun relating to its subject matter.  It supersedes all prior or
  92. contemporaneous oral or written communications, proposals,
  93. representations and warranties and prevails over any conflicting or
  94. additional terms of any quote, order, acknowledgment, or other
  95. communication between the parties relating to its subject matter
  96. during the term of this Agreement.  No modification of this Agreement
  97. will be binding, unless in writing and signed by an authorized
  98. representative of each party.

  102.                          SUPPLEMENTAL LICENSE TERMS
  103.  
  104. These supplemental license terms ("Supplemental Terms") add to or
  105. modify the terms of the Binary Code License Agreement (collectively,
  106. the "Agreement"). Capitalized terms not defined in these Supplemental
  107. Terms shall have the same meanings ascribed to them in the
  108. Agreement. These Supplemental Terms shall supersede any inconsistent
  109. or conflicting terms in the Agreement, or in any license contained
  110. within the Software.
  111.  
  112. 1.  Software Internal Use and Development License Grant.  Subject to
  113. the terms and conditions of this Agreement, including, but not limited
  114. to Section 4 (Java Technology Restrictions) of these Supplemental
  115. Terms, Sun grants you a non-exclusive, non-transferable, limited
  116. license to reproduce internally and use internally the binary form of
  117. the Software complete and unmodified for the sole purpose of
  118. designing, developing and testing your Java applets and applications
  119. intended to run on the Java platform ("Programs").
  120.  
  121. 2.  License to Distribute Software.  Subject to the terms and
  122. conditions of this Agreement, including, but not limited to Section 4
  123. (Java Technology Restrictions) of these Supplemental Terms, Sun grants
  124. you a non-exclusive, non-transferable, limited license to reproduce
  125. and distribute the Software, provided that (i) you distribute the
  126. Software complete and unmodified (unless otherwise specified in the
  127. applicable README file) and only bundled as part of, and for the sole
  128. purpose of running, your Programs, (ii) the Programs add significant
  129. and primary functionality to the Software, (iii) you do not distribute
  130. additional software intended to replace any component(s) of the
  131. Software (unless otherwise specified in the applicable README file),
  132. (iv) you do not remove or alter any proprietary legends or notices
  133. contained in the Software, (v) you only distribute the Software
  134. subject to a license agreement that protects Sun's interests
  135. consistent with the terms contained in this Agreement, and (vi) you
  136. agree to defend and indemnify Sun and its licensors from and against
  137. any damages, costs, liabilities, settlement amounts and/or expenses
  138. (including attorneys' fees) incurred in connection with any claim,
  139. lawsuit or action by any third party that arises or results from the
  140. use or distribution of any and all Programs and/or Software. (vi)
  141. include the following statement as part of product documentation
  142. (whether hard copy or electronic), as a part of a copyright page or
  143. proprietary rights notice page, in an "About" box or in any other form
  144. reasonably designed to make the statement visible to users of the
  145. Software: "This product includes code licensed from RSA Security,
  146. Inc.", and (vii) include the statement, "Some portions licensed from
  147. IBM are available at http://oss.software.ibm.com/icu4j/".

  149. 3.  License to Distribute Redistributables.  Subject to the terms and
  150. conditions of this Agreement, including but not limited to Section 4
  151. (Java Technology Restrictions) of these Supplemental Terms, Sun grants
  152. you a non-exclusive, non-transferable, limited license to reproduce
  153. and distribute those files specifically identified as redistributable
  154. in the Software "README" file ("Redistributables") provided that: (i)
  155. you distribute the Redistributables complete and unmodified (unless
  156. otherwise specified in the applicable README file), and only bundled
  157. as part of Programs, (ii) you do not distribute additional software
  158. intended to supersede any component(s) of the Redistributables (unless
  159. otherwise specified in the applicable README file), (iii) you do not
  160. remove or alter any proprietary legends or notices contained in or on
  161. the Redistributables, (iv) you only distribute the Redistributables
  162. pursuant to a license agreement that protects Sun's interests
  163. consistent with the terms contained in the Agreement, (v) you agree to
  164. defend and indemnify Sun and its licensors from and against any
  165. damages, costs, liabilities, settlement amounts and/or expenses
  166. (including attorneys' fees) incurred in connection with any claim,
  167. lawsuit or action by any third party that arises or results from the
  168. use or distribution of any and all Programs and/or Software, (vi)
  169. include the following statement as part of product documentation
  170. (whether hard copy or electronic), as a part of a copyright page or
  171. proprietary rights notice page, in an "About" box or in any other form

  177. 4.  Java Technology Restrictions.  You may not modify the Java
  178. Platform Interface ("JPI", identified as classes contained within the
  179. "java" package or any subpackages of the "java" package), by creating
  180. additional classes within the JPI or otherwise causing the addition to
  181. or modification of the classes in the JPI.  In the event that you
  182. create an additional class and associated API(s) which (i) extends the
  183. functionality of the Java platform, and (ii) is exposed to third party
  184. software developers for the purpose of developing additional software
  185. which invokes such additional API, you must promptly publish broadly
  186. an accurate specification for such API for free use by all developers.
  187. You may not create, or authorize your licensees to create, additional
  188. classes, interfaces, or subpackages that are in any way identified as
  189. "java", "javax", "sun" or similar convention as specified by Sun in
  190. any naming convention designation.
  191.  
  192. 5.  Notice of Automatic Software Updates from Sun.  You acknowledge
  193. that the Software may automatically download, install, and execute
  194. applets, applications, software extensions, and updated versions of
  195. the Software from Sun ("Software Updates"), which may require you to
  196. accept updated terms and conditions for installation. If additional
  197. terms and conditions are not presented on installation, the Software
  198. Updates will be considered part of the Software and subject to the
  199. terms and conditions of the Agreement.

  201. 6.  Notice of Automatic Downloads.  You acknowledge that, by your use
  202. of the Software and/or by requesting services that require use of the
  203. Software, the Software may automatically download, install, and
  204. execute software applications from sources other than Sun ("Other
  205. Software"). Sun makes no representations of a relationship of any kind
  206. to licensors of Other Software. TO THE EXTENT NOT PROHIBITED BY LAW,
  207. IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR ANY LOST REVENUE,
  208. PROFIT OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR
  209. PUNITIVE DAMAGES, HOWEVER CAUSED REGARDLESS OF THE THEORY OF
  210. LIABILITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE
  211. OTHER SOFTWARE, EVEN IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF
  212. SUCH DAMAGES.
  213.  
  214. 7.  Trademarks and Logos.  You acknowledge and agree as between you
  215. and Sun that Sun owns the SUN, SOLARIS, JAVA, JINI, FORTE, and iPLANET
  216. trademarks and all SUN, SOLARIS, JAVA, JINI, FORTE, and
  217. iPLANET-related trademarks, service marks, logos and other brand
  218. designations ("Sun Marks"), and you agree to comply with the Sun
  219. Trademark and Logo Usage Requirements currently located at
  220. http://www.sun.com/policies/trademarks. Any use you make of the Sun
  221. Marks inures to Sun's benefit.

  223. 8.  Source Code.  Software may contain source code that is provided
  224. solely for reference purposes pursuant to the terms of this Agreement.
  225. Source code may not be redistributed unless expressly provided for in
  226. this Agreement.
  227.  
  228. 9.  Termination for Infringement.  Either party may terminate this
  229. Agreement immediately should any Software become, or in either party's
  230. opinion be likely to become, the subject of a claim of infringement of
  231. any intellectual property right.
