  5. By using this software, you are agreeing to be bound 
  6. by all terms of this License. If you, the purchaser 
  7. and main end user hereinafter designated as "you", 
  8. "your", do not agree to the terms of this License,

  10. and its complete packaging for a full refund.

  15. In consideration of payment of the License fee, 
  16. which is a portion of the price you paid, the

  18. in or generated by the software, and data 
  19. accompanying this License (the "Software") 
  20. and related documentation are licensed (not sold) 
  21. to you by Disney Interactive, Inc. ("Disney"). 
  22. Disney does not transfer title to the Software to you; 
  23. this License shall not be considered a "sale" of the 
  24. Software. You own the CD ROM on which the 
  25. Software is recorded, but Disney retains full and 
  26. complete title to the Software on the CD ROM 
  27. and the accompanying documentation, and all 
  28. intellectual and industrial property rights therein.  
  29. This non-exclusive and personal License 
  30. gives you the right to use and display this 
  31. copy of the Software.

  35. RESTRICTIONS.

  37. The Software contains copyrighted material, 
  38. trade secrets, and other proprietary material.  
  39. You may not re-sell, decompile, reverse engineer,

  41. human-perceivable form.  Except as provided for 
  42. in this License, you may not copy, modify, network, 
  43. rent, lease, or otherwise distribute the Software;  
  44. nor can you make the Software available by 
  45. "bulletin boards," on-line services, Internet 
  46. web-pages, remote dial-in, or network or 
  47. telecommunications links of any kind;  nor can
  48. you create derivative works or any other works 
  49. that are based upon or derived from the Software 
  50. in whole or in part.  Within the terms of this
  51. License agreement, you may transfer all of the 
  52. license rights to the Software to another party, 
  53. provided that the original CD ROM containing 
  54. the Software, the related documentation, all copyright 
  55. notices, and a copy of this License are transferred 
  56. to that party, and provided that party reads and 
  57. agrees to accept the terms and conditions of this 
  58. License.  If you transfer the Software, you must
  59. remove the Software from your hard disk drive 
  60. and you may not retain any copies of the Software 
  61. for your own use.  This Software is for your PERSONAL, 
  62. NON-COMMERCIAL, and NON-GOVERNMENTAL use only.

  65. FURTHER RESTRICTIONS ON USE FOR SOFTWARE

  68. If the Software provides you with the ability to print 
  69. images containing Disney's copyrighted characters, 
  70. this License only allows you to print the images on 
  71. paper only and use them as printed by your computer's 
  72. printer for your PERSONAL, NON-COMMERCIAL, 
  73. and NON-GOVERNMENTAL use provided that you 
  74. preserve all copyright notices that are included with 
  75. the images as generated by the Software.This means 
  76. that you may, for example, use the Software to print 
  77. invitations on your computer's printer to your own 
  78. family party.  You may not, for example, use this 
  79. Software to print invitations for functions or events 
  80. sponsored by a business, charity, church, or 
  81. educational institution.  Without limiting the 
  82. foregoing, you may not use images generated by 
  83. the Software in connection with any advertising 
  84. or promotional materials, whether for profit or not 
  85. for profit.  Use of images generated by the Software 
  86. for any purpose not specifically allowed by this 
  87. License is a violation of Disney's copyrights, 
  88. trademarks and other proprietary rights and will result
  89. in the immediate termination of this License.

  92. TERMINATION.

  94. This License is effective until terminated by either 
  95. party.  You may terminate this License at any time 
  96. by returning the Software to Disney or destroying 
  97. the Software and all related documentation and all 
  98. copies and installations thereof, whether made under 
  99. the terms of this License or otherwise.  This License 
  100. will terminate immediately without notice from 
  101. Disney if you fail to comply with any provision of 
  102. this License.  Upon termination, you must destroy 
  103. or return to Disney the Software and related 
  104. documentation and all copies thereof, whether 
  105. made under the terms of this License or otherwise.

  108. LIMITED WARRANTY AND DISCLAIMER.

  110. DISNEY WARRANTS THE CD ROM ON WHICH THE SOFTWARE IS 
  111. RECORDED TO BE FREE FROM DEFECTS IN MATERIALS AND 
  112. WORKMANSHIP UNDER NORMAL USE FOR A PERIOD OF NINETY 
  113. (90) DAYS FROM THE DATE OF PURCHASE AS EVIDENCED BY 
  114. A COPY OF THE SALES RECEIPT OR PACKING SLIP.  DISNEY'S
  115. ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY WILL BE 
  116. REPLACEMENT OF THE DEFECTIVE CD ROM(S) OR REFUND OF 
  117. THE PURCHASE PRICE (AT DISNEY'S ELECTION) UPON RETURN
  118.  OF THE SOFTWARE TO DISNEY WITH A COPY OF YOUR PROOF 
  119. OF PURCHASE. EXCEPT IF THE SOFWARE IS SUBMITTED TO A 
  120. SPECIFIC GUARANTEE OR SUPPORT SERVICE AS REFERRED TO 
  121. IN THE TERMS AND CONDITIONS OF THE DISTRIBUTION AND/OR 
  122. THE MANUFACTURER AND/OR DISTRIBUTOR OF THE PRODUCT 
  123. WITH WHICH THE SOFTWARE IS ATTACHED. DISNEY WILL HAVE 
  124. NO RESPONSIBILITY TO REPLACE A CD ROM DAMAGED BY 
  125. ACCIDENT, ABUSE OR MISAPPLICATION. ANY IMPLIED 
  126. WARRANTIES AND/OR CONDITIONS ON THE CD ROM, 
  127. INCLUDING THE IMPLIED WARRANTIES AND/OR CONDITIONS 
  128. OF MERCHANTABILITY AND FITNESS FOR A 
  129. PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO 
  130. NINETY (90) DAYS FROM THE DATE OF PURCHASE OR DELIVERY.

  143. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.  
  144. DISNEY DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED 
  145. IN THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, 
  146. OR THAT DEFECTS INTHE SOFTWARE WILL BE CORRECTED.  
  147. FURTHERMORE, DISNEY DOES NOT WARRANT OR MAKE ANY 
  148. REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF 
  149. THE USE OF THE SOFTWARE AND RELATED DOCUMENTATION 
  150. IN TERMS OF THEIR CORRECTNESS, ACCURACY, 
  151. RELIABILITY, OR OTHERWISE. THE LIMITATIONS OF 
  152. LIABILITIES DESCRIBED IN THIS SECTION ALSO APPLY TO 
  153. THE THIRD PARTY SUPPLIERS OF MATERIALS USED IN THE 
  154. SOFTWARE.  NO ORAL OR
  155. WRITTEN INFORMATION OR ADVICE BY DISNEY OR A DISNEY 
  156. AUTHORIZED REPRESENTATIVE SHALL CREATE WARRANTIES 
  157. AND/OR CONDITIONS OR IN ANY WAY INCREASE THE SCOPE 
  158. OF THIS LIMITED WARRANTY. YOU (AND NOT DISNEY) ASSUME 
  159. THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR 
  160. CORRECTION.  SOME JURISDICTIONS DO NOT ALLOW THE 
  161. EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE 
  162. EXCLUSION MAY NOT APPLY TO YOU.

  166. LIMITATION OF LIABILITY.

  169. Disney be liable for any special or consequential 
  170. damages that result from the use of, or the inability to 
  171. use, the software or related documentation, even if 
  172. Disney or a Disney authorized representative has been 
  173. advised of the possibility of such damages.  Some 
  174. jurisdictions do not allow the limitation or exclusion 
  175. of liability or incidental or consequential damages, 
  176. so the above limitation or exclusion may not apply 
  177. to you.  In no event shall Disney's total liability to 
  178. you for all damages, losses, and causes of action 
  179. (whether in contract, tort (including negligence) 
  180. or otherwise) exceed the amount paid by you for 
  181. the Software.

  185. GOVERNING LAW AND SEVERABILITY.

  187. This License shall be governed by and construed in 
  188. accordance with the laws of the main residence 
  189. where you live, if such a main residence is within 
  190. the European Union. If your main residence is outside 
  191. the European Union, the applicable laws shall be the 
  192. laws of the State of California, without giving effect to 
  193. any principles of conflicts of law.  If any provision of 
  194. this License shall be unlawful, void, or for any 
  195. reason unenforceable, then that provision shall be 
  196. deemed severable from this License and shall not 
  197. affect the validity and enforceability of any 
  198. remaining provisions.  This is the entire agreement 
  199. between the parties relating to the subject matter 
  200. herein and shall not be modified except in writing, 
  201. signed by both parties.
