BEFORE INSTALLING AND USING THIS SOFTWARE, YOU MUST AGREE TO THE FOLLOWING:
SINGLE END-USER SOFTWARE LICENSE AGREEMENT
WORD TRANSLATOR and WORD TRANSLATOR '97
IMPORTANT -- READ CAREFULLY: This Single End-User License Agreement ("LICENSE") is a legal agreement between you, the end-user (either individually or as an entity), and Translation Experts Ltd. ("TRANSLATION EXPERTS") for the installation and use of the Word Translator '97 software program which includes computer software and associated electronic, machine readable files and may include other media, printed materials and on-screen or other electronic documentation ("SOFTWARE").
The SOFTWARE is protected by copyright law and by international copyright treaties and conventions in addition to other intellectual property laws. The SOFTWARE is licensed NOT sold, thereby, you have only purchased a LICENSE to install and use the SOFTWARE, NOT any form of ownership in the SOFTWARE.
The SOFTWARE is owned by and is the intellectual property of TRANSLATION EXPERTS, therefore, you must legally treat the SOFTWARE like any other intellectual property or proprietary material.
SOFTWARE LICENSE -- By installing the SOFTWARE you agree to accept and be bound by all the terms, conditions and provisions of this LICENSE. If you do not agree with the terms, conditions and provisions of this LICENSE, do NOT continue with the installation of this SOFTWARE and promptly return the entire SOFTWARE package in an undamaged condition (including all provided SOFTWARE on any medium as well as all accompanying documentation, written materials and packaging) to the place where you acquired it.
Your acceptance of and agreement to this LICENSE permits you to install and use the SOFTWARE including program(s), help files, accompanying bi-directional dictionaries, associated files, other media, printed and on-screen or other electronic documentation on one (1) single computer at any one (1) time.
You may not use the SOFTWARE on a multi-user or network system that is used by more than one (1) single user at any one (1) time. Use of the SOFTWARE on a multi-user or network system by more than one (1) single user at any one (1) time requires that you to purchase a separate LICENSE for each individual user on the network or multi-user system.
You may not duplicate or copy the SOFTWARE except to the extent that you backup your entire system or make, update and maintain one (1) single copy for backup or archival purposes only.
You may not loan, rent, lease or transfer the SOFTWARE to any third party except on a permanent basis, provided that you do not retain any copies of the SOFTWARE or any accompanying written or electronic documentation, and that the third party agrees in writing to all the terms of this LICENSE.
You may not reverse engineer, decompile, disassemble, modify, adapt, translate or create derivative works from the SOFTWARE except to the extent normally allowed and provided by the SOFTWARE to alter, modify, translate and otherwise customize certain files.
You acknowledge that the LICENSE granted to you is a limited one and shall in no way be construed to provide you either express or implied right, license or ownership to any of the intellectual property rights owned by and the property of TRANSLATION EXPERTS except to the extent set forth above. Additionally, this LICENSE in no way confers to you or anyone else any right, title or interest to any of the intellectual property rights in the SOFTWARE owned by TRANSLATION EXPERTS.
The SOFTWARE is owned by and is the intellectual property of TRANSLATION EXPERTS and is protected by copyright laws and other international copyright treaties and conventions as well as other intellectual property laws. Therefore, you must legally treat the SOFTWARE like any other intellectual property or proprietary material.
The SOFTWARE and related printed and electronic documentation are provided "as is." TRANSLATION EXPERTS disclaims all other warranties, either expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the SOFTWARE and any accompanying printed or electronic documentation.
The SOFTWARE and accompanying printed documentation have been carefully checked for performance and accuracy and are believed to be reliable. TRANSLATION EXPERTS does not assume any liability arising out of the application, use or misuse of the SOFTWARE and related printed or electronic documentation.
The information contained in the accompanying documentation is subject to change without notice. You may not copy any of the accompanying documentation without the prior and express written consent of TRANSLATION EXPERTS. Additionally, from time to time, and at their sole discretion, TRANSLATION EXPERTS reserves the right to make changes to the SOFTWARE herein described to improve its function and/or design.
This LICENSE is effective until terminated. TRANSLATION EXPERTS has the right to terminate this LICENSE immediately if there is any failure to comply with any provision of this LICENSE. Upon any written notice of termination of this LICENSE, all SOFTWARE and accompanying documentation must be immediately returned or destroyed and all use of same ceased.
By opening and installing this SOFTWARE you acknowledge that you have read this LICENSE, understand it, agree with its provisions and that it is a complete and binding statement of your agreement with TRANSLATION EXPERTS. If you acquired the SOFTWARE in the United States, this LICENSE shall be governed by and construed in accordance with the laws of the United States and the State of Colorado. If you acquired this SOFTWARE outside of the United States, local laws may apply.

U.S. GOVERNMENT RESTRICTED RIGHTS -- The Word Translator SOFTWARE program(s), accompanying bi-directional dictionaries, associated electronic files, other media if included, printed and on-screen or other electronic documentation are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restriction as set forth in subdivision (c) (1) (ii) of the Rights in Technical Data and Computer Software clause at 252.277-7013.
LIMITED WARRANTY -- TRANSLATION EXPERTS warrants that the SOFTWARE will perform substantially as described in the accompanying written and electronic documentation provided by TRANSLATION EXPERTS for a period of thirty (30) days from the date of acquisition and that TRANSLATION EXPERTS will make reasonable efforts to provide solutions for and solve any functionality problems or issues. Some jurisdictions do not allow limitations on the duration of implied warranties, consequently, the above limitation may not be applicable to you. To the extent allowed by applicable law, implied warranties for the SOFTWARE, if any, are limited to thirty (30) days.
CUSTOMER REMEDIES -- TRANSLATION EXPERTS entire liability and your exclusive remedy shall be, at TRANSLATION EXPERTS' option, either (a) return of the purchase price of the SOFTWARE or (b) replacement of SOFTWARE that is returned to TRANSLATION EXPERTS. A copy of the original purchase receipt is required for either the return or replacement of the SOFTWARE. This limited warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.
NO OTHER WARRANTIES -- To the maximum extent allowed by applicable law, TRANSLATION EXPERTS, its licensees, suppliers, wholesalers, resellers and dealers disclaim all other express or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, title and non-infringement, with regard to the SOFTWARE, and the provision or failure to provide support services. This limited warranty gives you specific legal rights and you may have others depending upon the jurisdiction.
LIMITATION OF LIABILITY -- To the maximum extent allowed by applicable law, in no event shall TRANSLATION EXPERTS, its licensees, distributors or resellers be held liable for any damage whatsoever including, without limitation, damages arising for loss of business profits or any other profits, damage to equipment or data, business interruption, loss of business information, or any other loss or damage of any nature, including, but not limited to, direct, indirect, special incidental, consequential or other damage or pecuniary loss or the provision of or failure to provide support services arising out of the use or inability to use the software or any document created using the SOFTWARE or any associated program, file, help file or any of the written or electronic documentation accompanying the SOFTWARE.
