  14. Hyperion Entertainment CVBA is
  15. pleased to announce that on September
  16. 30, 2009, it has reached a
  17. comprehensive settlement agreement
  18. with Amiga, Inc., Itec LLC and Amino
  19. Development Corporation, Inc., to
  20. bring all ongoing litigation and
  21. worldwide pending procedures between
  22. the parties to an end.
  23.  
  24. As part of the settlement agreement,
  25. the Amiga Parties acknowledge that
  26. Hyperion is the sole owner of AmigaOS
  27. 4 without prejudice to any third
  28. party rights.
  29.  
  30. Within the framework of the
  31. settlement agreement Hyperion is
  32. granted an exclusive, perpetual,
  33. worldwide right to AmigaOS 3.1 in
  34. order to use, develop, modify,
  35. commercialize, distribute and market
  36. AmigaOS 4.x (and subsequent versions
  37. of AmigaOS including without
  38. limitation AmigaOS 5) in any form, on
  39. any medium and for any current or
  40. future hardware platform under the
  41. exclusive trademark "AmigaOS" (Amiga
  42. operating system) and using other
  43. associated trademarks (such as the
  44. "BoingBall" logo).

  46. Hyperion will continue development
  47. and distribution of AmigaOS 4.x (and
  48. beyond) as it has done since November
  49. of 2001.

  51. We wish to thank our loyal customers
  52. who have supported us throughout the
  53. judicial procedures and especially
  54. the AmigaOS 4.x development team for
  55. their continued efforts and at the
  56. request of whom this official
  57. announcement was made.

  59. As Hyperion Entertainment's most
  60. ambitious project to date is drawing
  61. to a close in collaboration with our
  62. partners, we invite our current and
  63. prospective customers to watch this
  64. space for further updates on
  65. Hyperion's continued efforts to
  66. revive the Amiga platform.
