  1.                     License Agreement and Limited Warranty

  4. 1. Introduction.  This agreement explains when and how you may use 
  5.    Unregistered and Registered Copies of Oxygen Phone Manager II for Nokia
  6.    phones.
  7.  
  8.    In this agreement:
  9.  
  10.    *  "Oxygen Phone Manager II" means the Oxygen Phone Manager II for
  11.       Nokia phones program you have purchased or obtained for 
  12.       evaluation.
  13.  
  14.    *  "Unregistered Copy" means a copy of Oxygen Phone Manager II
  15.       distributed by us for evaluation.  
  16.  
  17.    *  "Registered Copy" means a copy of the Oxygen Phone Manager II
  18.       purchased from us.
  19.  
  20.    *  "we" or "us" means Oxygen Software.
  21.  
  22.    *  "you" means the end user of Oxygen Phone Manager II.
  23.  
  24.    *  "Commercial Application" any application that will be distributed
  25.       to others for any kind of compensation or fee.  This includes
  26.       shareware and other try before you buy as well as commercial
  27.       distribution methods.

  30. 2. Legal Agreement.  This is a legal agreement which allows you, the end
  31.    user, to use Oxygen Phone Manager II under certain terms and
  32.    conditions.  If you cannot agree to abide by the terms of this
  33.    agreement you should not use Oxygen Phone Manager II.
  34.    Oxygen Software reserves the right to change this license
  35.    agreement for the future versions of Oxygen Phone Manager II.

  37. 3. Use of Oxygen Phone Manager II. You may use the Unregistered Copy of 
  38.    Oxygen Phone Manager II on as many computers as you like for a 30 
  39.    day period. After that period, you must either register Oxygen 
  40.    Phone Manager or remove it from all the computers you had 
  41.    installed it on.

  43.    You assume full responsibility for the selection and use of
  44.    Oxygen Phone Manager II to achieve your intended results.

  46. 4. Copying Registered Copies of Oxygen Phone Manager II. When you receive 
  47.    a Registered Copy of Oxygen Phone Manager II you may make copies of 
  48.    Oxygen Phone Manager II which are necessary for normal backup purposes.  
  49.    You agree not to make any other copies of the software, or any part of 
  50.    them, or sell or give any copies to others, without our advance written 
  51.    permission.

  53. 5. Licensing for Oxygen Phone Manager II is as follows:

  77.  After registration you receive full version download link, unlock code and
  78.  installtion instructions. Once you activate this code the program is ready
  79.  to work. The number of phones allowed by the license is shown in the tables
  80.  below (Price section). This value shows maximum number of phones that will
  81.  be handled by the software simultaneously. Registration/Unregistration of
  82.  the phones is very simple and convenient. If you changed the phone or bought
  83.  another one, just choose "Register/Unregister phone" item in "Phone" menu
  84.  and select what phone(s) you need to be added to (or removed from) your
  85.  license. Program sends this information to Oxygen Registration Robot. The
  86.  Robot will provide you with updated registration code. Usually it takes only
  87.  several minutes. Note that once you removed the phone from the license, you
  88.  won't be able to use it with Oxygen Phone Manager II again as removing phone
  89.  from your license means that you're no longer using it.

  93. 6. LIMITED WARRANTY:  The following limited warranty applies to Unregistered
  94.    and Registered Copies of Oxygen Phone Manager II. 
  95.  
  96.    Bugs and Program Errors.  We do not promise that Oxygen Phone 
  97.    Manager will be free of bugs or program errors. If you report a program 
  98.    error or bug to us, we will use our best efforts to correct it. If we 
  99.    issue a maintenance release for Oxygen Phone Manager II which includes 
  100.    a correction for an error you reported, we will send you a copy of that 
  101.    maintenance release at no charge. We will only do this for maintenance 
  102.    releases, not for new major releases or other new versions of Oxygen 
  103.    Phone Manager.

  105.    Hardware damages.  We are not responsible for any possible damages which 
  106.    may occur with your mobile phone or PC during use or misuse of our 
  107.    software. We are also not responsible for any problems caused by original
  108.    or hand-made connection cables.

  110. 7. Disclaimer.

  112.    Except for the limited warranty stated above, we disclaim any and all 
  113.    other warranties, express or implied, oral or written, including any 
  114.    implied warranties of merchantability or fitness for a particular 
  115.    purpose. Oxygen Software reserves the right to change this license
  116.    agreement for the future versions of Oxygen Phone Manager II.
