  4. License Terms

  6. of the Swiss Federal Institute of Technology Zuerich (Eidgenoessische 
  7. Technische Hochschule Zuerich [ETHZ]), represented by Prof. Dr. Juerg 
  8. Gutknecht, Institute for Computer Systems, (hereafter Institute), 
  9. concerning the Source Code to the software ETH Oberon.

  12. Article 1  Subject
  13.  
  14. Subject of these license terms is the source code of the software system
  15. ETH Oberon, hereafter referred to as source code.
  16.  
  17.  
  18. Article 2  Rights of the Licensee
  19.  
  20. The Licensee shall be granted the right to use the source code in whole or in
  21. part for private use, for conversion to another platform or for production of
  22. an application software, to grant sub-licenses of the source code as well as,
  23. under the condition of Article 3, to adapt or to modify it. The Licensee 
  24. shall not be allowed to use the source code or derivatives thereof 
  25. commercially, unless this right has been granted explicitly.

  28. Article 3  Prohibition
  29.  
  30. (1) The Licensee may not do either of the following
  31.     (a) modify the interfaces of the source code in any way that disagrees
  32.         with style and content of the system.
  33.     (b) produce conversions to another platform that disagree with style and
  34.         content of the system.
  35.  
  36. (2) In case of doubt the Institute shall be asked for written consent.
  37.  
  38.  
  39. Article 4  Obligations of the Licensee
  40.  
  41. (1) Sub-licenses must confer the identical legal position which is granted by
  42. the present license terms. The Sub-Licensee must therefore be entitled to
  43. the same rights and must be bound by the same obligations as well as by the
  44. same prohibition as the Licensee.
  45.  
  46. (2) The source code of each module, also in each copy, must at the beginning
  47. refer to the present license terms as follows:

  53. (3) The source code and each conversion resulting from its utilization must 
  54. be provided with the name Oberon and designate as author the "Team of the 
  55. Institute for Computer Systems of ETH Zuerich" at the beginning. Any further
  56. developments, updates and applications must be marked "based on Oberon".
  57.  
  58. (4) Modifications by the Licensee are to be clearly identified.
  59.  
  60.  
  61. Article 5  Consequences of Infringements
  62.  
  63. Each infringement of these license terms shall directly result in the loss of
  64. the rights granted in Article 2. There shall be no right to distribute those
  65. products which have been produced in violation of this contract.

  68. Article 6  Information
  69.  
  70. (1) Upon request the Institute (e-mail: oberon@inf.ethz.ch) shall provide the
  71. Licensee with information on modifications, updates and further developments
  72. of the source code by the Institute.
  73.  
  74. (2) Upon request the Licensee and each Sub-Licensee shall disclose to the
  75. Institute their applications, modifications, updates and further developments
  76. of the source code as well as the thereby gained experiences and knowledge.

  79. Article 7  Liability
  80.  
  81. (1) The Institute does not assume any liability for damage directly or 
  82. indirectly caused by the application of the source code.
  83.  
  84. (2) If a third party takes legal action based on infringement of its 
  85. protective rights by the Licensee's use of the source code, the contract
  86. party sued must immediately notify the other contract party. The Licensee is
  87. not entitled to conclude a settlement without the expressive and written 
  88. consent of the Institute.

  91. Article 8  Modifications
  92.  
  93. The Institute may modify these license terms. The valid version may be
  94. downloaded or requested as mentioned in Article 4 sub-paragraph 2.

  97. Article 9  Validity and Duration of License
  98.  
  99. (1) Upon receipt of the source code these license terms are deemed to be
  100. accepted.
  101.  
  102. (2) By notification with registered mail, the Institute may withdraw the
  103. license or the sub-license with immediate effect.
  104.  
  105. (3) The obligations of the licensee according to Articles 3 and 4 
  106. sub-paragraphs 2 - 4 shall remain effective even after the termination
  107. of the license.

  109.  
  110. Article 10  Applicable Law and Place of Jurisdiction
  111.  
  112. This Agreement is governed by Swiss law. Place of jurisdiction is Zuerich.
