  6. The object of this licence is the YaST (Yet another Setup Tool) program,
  7. the name YaST, together with SuSE Linux, the Linux Distribution of 
  8. SuSE GmbH, all programme derived from YaST and all works or names
  9. derived in full or in part thereof together with the use, application,
  10. archiving, reproduction and passing on of YaST, all programs derived
  11. from YaST and all works derived in full or in part thereof.  The YaST
  12. program and all sources is the intellectual property of SuSE GmbH
  13. within the meaning of the Copyright Law.  The name YaST is a registered
  14. trademark of SuSE GmbH.  In the following SuSE GmbH is the 
  15. licensor and every user or processor of YaST or works derived in full
  16. or in part thereof, together with every person who reproduces, 
  17. distributes or archives YaST or SuSE Linux, is the licensee of
  18. SuSE GmbH.

  20. The following licence terms are recognised as a result of the processing,
  21. use, application, archiving reproduction and dissemination of YaST.

  23. Only this licence gives the Licensee the right to use reproduce, to 
  24. distribute or to amend YaST or works derived from it.  These actions are
  25. forbidden by the copyright act, if this licence is not recognised. If 
  26. this licence is recognised and complied with in full, it is also valid
  27. even without the written consent of the Licensee.

  29. 1. Usage
  30.    YaST and SuSE Linux may be used for personal and commercial
  31.    purposes if the copyright and licence terms of the installed packages
  32.    and programmes are observed. The use of YaST, even if a modified 
  33.    version is used, does NOT exempt in particular the Licensee from the 
  34.    duty to take due care with regard to the licence terms of the 
  35.    packages or programmes installed through YaST or works based on it.

  37. 2. Processing
  38.    All programmes derived from YaST and all works derived from it in full
  39.    or parts thereof are to be filled on the opening screen with the clear
  40.    information "Modified Version". Moreover the operator give his name on
  41.    the opening screen, stating that SuSE GmbH is not providing any
  42.    support for the "Modified Version" and is excluded from any liability
  43.    whatsoever. Every amendment to the sources which are not conducted by
  44.    SuSE GmbH are deemed to be a "Modified Version". The Licensee is
  45.    entitled to change his copy from the sources of YaST, whereby a work
  46.    based on the YaST programme is created, provided that the following 
  47.    conditions are satisfied.

  49.    a) Every amendment must have a note in the source with date and 
  50.       operator.  The amended sources must be made available for the user
  51.       in accordance with section 3) together with the unamended licence.
  52.  
  53.    b) The Licensee is obliged to make all work distributed by him which
  54.       is derived as a whole or in part from YaST or parts of YaST to
  55.       third parties as a whole under the terms of this licence without
  56.       royalties.

  58.    c) The amendment of this licence by a Licensee, even in part, is 
  59.       forbidden.

  61.    SuSE GmbH reserves the right to accept parts or all amendments of
  62.    a modified version of YaST into the official version of YaST free of
  63.    charge. The Licensee has no bearing on this.

  65. 3. Dissemination
  66.    It is forbidden to reproduce or distribute data carriers which have 
  67.    been reproduced without authorisation for payment without the prior
  68.    written consent of SuSE GmbH or SuSE Linux.  Distribution of
  69.    the YaST programme, its sources, whether amended or unamended in full
  70.    or in part thereof, and the works derived thereof for a charge require
  71.    the prior written consent of SuSE GmbH.

  73.    All programmes derived from YaST, and all works derived thereof as a
  74.    whole or parts thereof may only be disseminated with the amended
  75.    sources and this licence in accordance with 2b).  Making YaST or 
  76.    works derived thereof available free of charge together with SuSE
  77.    Linux on FTP Servers and mailboxes is permitted if the licences on the
  78.    software are observed.

  80. 4. Guarantee
  81.    No guarantee whatsoever is given for YaST or for works derived from 
  82.    it and SuSE Linux. The SuSE GmbH guarantee only covers 
  83.    fault-free data carriers.
  84.  
  85.    SuSE GmbH will provide YaST and SuSE Linux "AS IT IS" without
  86.    any guarantee whatever that it is fit for a specific purpose or use.
  87.    In particular SuSE is not liable for lost profit, savings not 
  88.    made, or damages from the claims lodged by third parties against the 
  89.    Licensee. SuSE GmbH is not liable either for other direct or 
  90.    indirect consequential losses, in particular not for the loss or 
  91.    production of recorded data.

  93.    The observance of the respective licences and copyrights of the 
  94.    installed software is incumbent solely upon the user of YaST and 
  95.    SuSE Linux.

  97. 5. Rights
  98.    No other rights to YaST or to SuSE Linux are granted other than 
  99.    those negotiated in this licence.  An infringement against this 
  100.    licence automatically terminates the rights of the Licensee. However
  101.    the right of third parties who have received copies or rights under
  102.    this licence from the Licensee, are not terminated as long as all
  103.    parts of his licence are recognised and observed.  If the Licensee
  104.    is subject to conditions, or obligations as a result of a court
  105.    judgement, patent terms, licence terms, or another reason, and these
  106.    conditions or obligations contradict this licence as a whole or in
  107.    part, the Licensee shall only be exempted in full or in part from 
  108.    this licence and its terms with the express prior written consent 
  109.    of SuSE. SuSE is entitled to withhold its consent without 
  110.    giving reasons.

  112. 6. Additional restrictions.
  113.    If the distribution or use of YaST and SuSE Linux or parts of 
  114.    SuSE Linux is restricted in a state either by patents or by 
  115.    interfaces protected by copyright, SuSE GmbH can specify an 
  116.    explicit geographic restriction of the distribution of YaST and 
  117.    SuSE Linux or parts of SuSE Linux, in which these states
  118.    are fully or partially excluded from distribution. In such a case 
  119.    this licence includes the whole or partial restriction as if it was 
  120.    written down in this licence.
