  4. Section 1. Definition. A durable power of attorney  is a power of 
  5. attorney by which a principal designates another his attorney in 
  6. fact in writing and the writing contains the words "This power of 
  7. attorney shall not be affected by subsequent disability or 
  8. incapacity of the principal," or "This power of attorney shall 
  9. become effective upon the disability or incapacity of the 
  10. principal," or similar words showing the intent of the principal 
  11. that the authority conferred shall be exercisable notwithstanding 
  12. the principal's subsequent disability or incapacity.

  14. Section 2. Durable Power of Attorney Not Affected by Disability. 
  15. All acts done by an attorney in fact pursuant to a durable power 
  16. of attorney during any period of disability or incapacity of the 
  17. principal have the same effect and inure to the benefit of and 
  18. bind the principal and his successors in interest as if the 
  19. principal were competent and not disabled.

  22. Section 3. Relation of Attorney in Fact to Court-appointed 
  23. Fiduciary. (a) If, following execution of a durable power of 
  24. attorney, a court of the principal's domicile appoints a 
  25. conservator, guardian of the estate, or other fiduciary charged 
  26. with the management of all of the principal's property or all of 
  27. his property except specified exclusions, the attorney in fact is 
  28. accountable to the fiduciary as well as to the principal. The 
  29. fiduciary has the same power or revoke or amend the power of 
  30. attorney that the principal would have had if he were not 
  31. disabled or incapacitated.

  34. (b) A principal may nominate, by a durable power of attorney, the 
  35. conservator, guardian of his estate, or guardian of his person, 
  36. for consideration by the court if protective proceedings for the 
  37. p73 principal's person or estate are thereafter commenced. The court 
  38. shall make its appointment with the principal's most recent 
  39. nomination in a durable power of attorney except for good cause 
  40. shown.

  42. Section 4. (a) The death of a principal who has executed a 
  43. written power of attorney, durable or otherwise, does not revoke 
  44. or terminate the agency as to the attorney in fact or other 
  45. person, who, without actual knowledge of the death of the 
  46. principal, acts in good faith under the power. Any action so 
  47. taken, unless otherwise invalid or unenforceable, binds 
  48. successors in interest to the principal.

  50. (b) The disability or incapacity of a principal who has 
  51. previously executed a written power of attorney that is not a 
  52. durable power of attorney that is not a durable power does not 
  53. revoke or terminate the agency as to the attorney in fact or 
  54. other person, who, without actual knowledge of the disability or 
  55. incapacity of the principal, acts in good faith under the power. 
  56. Any action so taken, unless otherwise invalid or unenforceable, 
  57. binds the principal and his successors in interest.

  59. Section 5. Proof of Continuance of Durable and Other Powers of 
  60. Attorney by Affidavit. As to acts undertaken in good faith 
  61. reliance thereon, an affidavit executed by the attorney in fact 
  62. under a  power of attorney, durable or otherwise, stating that he 
  63. did not have at the time of exercise of the power actual 
  64. knowledge of the termination of the power by revocation or of the 
  65. principal's death, disability, or incapacity is conclusive proof 
  66. of the nonrevocation or nontermination of the power at that time. 
  67. If the exercise of that power of attorney requires execution and 
  68. delivery of any instrument that is recordable, the affidavit when 
  69. authenticated for record is likewise recordable. This section 
  70. does not affect any provision in a power of attorney for its 
  71. termination by expiration of time or occurrence of an event other 
  72. than express revocation or a change in the principal's capacity.

  75. Section 6. Uniformity of Application and Construction. This Act 
  76. shall be applied and construed to effectuate its general purpose 
  77. to make uniform the law with respect to the subject of this Act 
  78. among the states enacting it.

  80. Section 7. Short title. This Act may be cited as the Uniform 
  81. Durable Power of Attorney Act.
