  8. SHAREWARE END-USER LICENSE AGREEMENT
  9.  
  10. This End-User License Agreement ("EULA") is for the PassMark
  11. PerformanceTest software.
  12.  
  13. This PassMark End-User License Agreement ("EULA") is a legal agreement
  14. between you (either an individual or a single entity) and PassMark
  15. Corporation for the PassMark software product identified above,
  16. which includes computer software and may include associated media,
  17. printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT").
  18. By installing, copying, or otherwise using the SOFTWARE PRODUCT,
  19. you agree to be bound by the terms of this EULA.
  20. If you do not agree to the terms of this EULA, do not install or use
  21. the SOFTWARE PRODUCT;

  23. 1. GRANT OF LICENSE. This EULA grants you the following rights:
  24. ╖ A license is granted only after the payment of the license fee.
  25. ╖ If no license fee has been pay the product can be used for
  26.   evaluation purposes for a maximum period of 30 days.
  27. ╖ After the application fee has been pay, you may install
  28.   and use one copy of the SOFTWARE PRODUCT, or any prior version
  29.   on a single computer, or on a single removable disk.
  30.   The SOFTWARE PRODUCT must NOT be installed on a network where
  31.   it could be used by more than a single computer.
  32. ╖ The primary user of the computer on which the licensed SOFTWARE PRODUCT
  33.   is installed may make a second copy for his or her exclusive use
  34.   on a portable computer.

  37. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  39. ╖ Limitations on Reverse Engineering, Decompilation, and Disassembly.
  40.   You may not reverse engineer, decompile, or disassemble the SOFTWARE
  41.   PRODUCT.
  42. ╖ The shareware version of the software may be freely distributed
  43.   provided that no fee is charged and the product is distributed
  44.   complete and intact.

  46. 3. COPYRIGHT.

  48.  All title and copyrights in and to the SOFTWARE PRODUCT
  49.  (including but not limited to any images, photographs, animations, video,
  50.  audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT),
  51.  the accompanying printed materials, and any copies of the SOFTWARE PRODUCT
  52.  are owned by PassMark or its suppliers. The SOFTWARE PRODUCT is protected
  53.  by copyright laws and international treaty provisions. Therefore, you
  54.  must treat the SOFTWARE PRODUCT like any other copyrighted material
  55.  except that you may install the licenced SOFTWARE PRODUCT on a single
  56.  computer provided you keep the original solely for backup or archival  purposes.

  58. LIMITED WARRANTY. PassMark warrants that (a) the licenced 
  59.  SOFTWARE PRODUCT will perform substantially in accordance
  60.  with the accompanying written materials for a period of
  61.  ninety (90) days from the date of receipt, and (b) any
  62.  Support Services provided by PassMark shall be substantially
  63.  as described in applicable written materials provided to
  64.  you by PassMark, and PassMark support engineers will
  65.  make commercially reasonable efforts to solve any problem
  66.  issues. Some states and jurisdictions do not allow
  67.  limitations on duration of an implied warranty, so
  68.  the above limitation may not apply to you. To the
  69.  extent allowed by applicable law, implied warranties
  70.  on the SOFTWARE PRODUCT, if any, are limited to ninety
  71.  (90) days. 
  72.  As no fee is charged for evalution and beta copies
  73.  no warranty is offered.
