  4. the software for up to 30days. If you like the software and
  5. decide to keep it then we ask you to purchase a copy.

  14. SHAREWARE END-USER LICENSE AGREEMENT

  16. This End-User License Agreement ("EULA") is for the PassMark
  17. MonitorTest software.
  18.  
  19. This PassMark End-User License Agreement ("EULA") is a legal agreement
  20. between you (either an individual or a single entity) and PassMark
  21. Corporation for the PassMark software product identified above,
  22. which includes computer software and may include associated media,
  23. printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT").
  24. By installing, copying, or otherwise using the SOFTWARE PRODUCT,
  25. you agree to be bound by the terms of this EULA.
  26. If you do not agree to the terms of this EULA, do not install or use
  27. the SOFTWARE PRODUCT;

  29. 1. GRANT OF LICENSE. This EULA grants you the following rights:
  30. ╖ A license is granted only after the payment of the license fee.
  31. ╖ If no license fee has been pay the product can be used for
  32.   evaluation purposes for a maximum period of 30 days.
  33. ╖ After the application fee has been pay, you may install
  34.   and use one copy of the SOFTWARE PRODUCT, or any prior version
  35.   on a single computer, or on a single removable disk.
  36.   The SOFTWARE PRODUCT must NOT be installed on a network where
  37.   it could be used by more than a single computer.
  38. ╖ The primary user of the computer on which the licensed SOFTWARE PRODUCT
  39.   is installed may make a second copy for his or her exclusive use
  40.   on a portable computer.

  43. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  45. ╖ Limitations on Reverse Engineering, Decompilation, and Disassembly.
  46.   You may not reverse engineer, decompile, or disassemble the SOFTWARE
  47.   PRODUCT.
  48. ╖ The shareware version of the software may be freely distributed
  49.   provided that no fee is charged and the product is distributed
  50.   complete and intact.

  52. 3. COPYRIGHT.

  54.  All title and copyrights in and to the SOFTWARE PRODUCT
  55.  (including but not limited to any images, photographs, animations, video,
  56.  audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT),
  57.  the accompanying printed materials, and any copies of the SOFTWARE PRODUCT
  58.  are owned by PassMark or its suppliers. The SOFTWARE PRODUCT is protected
  59.  by copyright laws and international treaty provisions. Therefore, you
  60.  must treat the SOFTWARE PRODUCT like any other copyrighted material
  61.  except that you may install the licenced SOFTWARE PRODUCT on a single
  62.  computer provided you keep the original solely for backup or archival  purposes.

  64. LIMITED WARRANTY. PassMark warrants that (a) the licenced 
  65.  SOFTWARE PRODUCT will perform substantially in accordance
  66.  with the accompanying written materials for a period of
  67.  ninety (90) days from the date of receipt, and (b) any
  68.  Support Services provided by PassMark shall be substantially
  69.  as described in applicable written materials provided to
  70.  you by PassMark, and PassMark support engineers will
  71.  make commercially reasonable efforts to solve any problem
  72.  issues. Some states and jurisdictions do not allow
  73.  limitations on duration of an implied warranty, so
  74.  the above limitation may not apply to you. To the
  75.  extent allowed by applicable law, implied warranties
  76.  on the SOFTWARE PRODUCT, if any, are limited to ninety
  77.  (90) days. 
  78.  As no fee is charged for evalution and beta copies
  79.  no warranty is offered.
