  89. ======== License Agreement for Use and Distribution =============

  91. The JPS Development License Agreement is a legal agreement between
  92. you and JPS Development for the JPS Development SOFTWARE PRODUCTS
  93. identified above. By installing, copying or using the SOFTWARE
  94. PRODUCT, you agree to be bound by terms of this agreement.
  95.  
  96. The Software is owned by JPS Development and is protected
  97. by copyright laws and international copyright treaties, as well
  98. as other intellectual property laws and treaties. The Software
  99. is licensed, not sold.
  100.  
  101. 1. DEFINITIONS.
  102.  
  103.   "Software" means the JPS Development software product, which
  104.   includes computer software and may include associated printed
  105.   materials and "online" or electronic documentation.
  106.  
  107.   "Unregistered Version" means a copy of the Software you obtained
  108.   for evaluation purposes. It is described as "Unregistered Version"
  109.   in the program's "About" dialog box and has some limitations as
  110.   explained above in this file.
  111.  
  112. 2. TRIAL USE LICENSE
  113.  
  114.   This License Agreement grants you the right to use
  115.   the Unregistered Version for evaluation purposes for a period
  116.   not longer than 30 days. The Unregistered Version is in use on
  117.   a computer when it is loaded into temporary memory (e.i. RAM)
  118.   of that computer. After 30 days starting from your first use
  119.   you must either register the Software or stop using it.
  120.  
  121. 3. REGISTERING SOFTWARE
  122.  
  123.   After paying a license fee you will receive the Registered
  124.   Version and you will be entitled to receive free upgrades
  125.   within the next 12 months. When we are about to release a new
  126.   version, an upgrade notice will be sent to you via e-mail.
  127.   Then, using a temporary password, you will be able to download
  128.   a registered copy of our latest software.
  129.  
  130. 4. COPYRIGHT AND OTHER RIGHTS AND LIMITATIONS
  131.  
  132.   You must treat the Software like any other copyrighted material.
  133.   You may not reverse engineer, decompile, modify, disassemble
  134.   or make copies of the Software except as provided elsewhere
  135.   in this agreement. All rights not expressly granted in this
  136.   agreement are reserved to JPS Development.
  137.  
  138. 5. LIMITED DISTRIBUTION LICENSE
  139.  
  140.   You may make copies of the Unregistered Version and give
  141.   it to others, or distribute it in any possible way (like
  142.   uploading online services, ftp sites and BBSes) as long as you:
  143.  
  144.   - include all of the unmodified files, as listed above
  145.     in this file;
  146.  
  147.   - agree to inform the users that the Unregistered Version may be
  148.     used for a time limited evaluation period, and that it must be
  149.     registered to continue to use the Program once the evaluation
  150.     period has ended;
  151.  
  152.   - do not bundle the Software with any other software without
  153.     written permission from JPS Development;
  154.  
  155. 6. DISCLAIMER OF WARRANTY
  156.  
  157.   The Software is provided "as is", without warranty of any kind.
  158.   JPS DEVELOPMENT DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING
  159.   ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS
  160.   FOR A PARTICULAR PURPOSE.
  161.  
  162.   TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT
  163.   SHALL JPS DEVELOPMENT OR ANYONE ELSE INVOLVED IN THE PRODUCTION
  164.   OR DELIVERY OF THE SOFTWARE BE LIABLE FOR ANY SPECIAL,
  165.   INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER
  166.   (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
  167.   PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION,
  168.   OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY
  169.   TO USE THE SOFTWARE, EVEN IF JPS DEVELOPMENT HAS BEEN ADVISED
  170.   OF THE POSSIBILITY OF SUCH DAMAGES.

  173. This agreement is governed by the laws of Poland.
