  5. YOUR USE OF THE TRIAL EDITION SOFTWARE DISTRIBUTED WITH THIS 
  6. LICENSE IS SUBJECT TO ALL OF THE TERMS AND CONDITIONS OF 
  7. THIS LICENSE STATEMENT. IF YOU DO NOT AGREE TO ALL OF THE 
  8. TERMS AND CONDITIONS OF THIS STATEMENT, DO NOT USE THE 
  9. SOFTWARE.

  11. 1. This Software is protected by copyright law and 
  12. international copyright treaty. Therefore, you must treat 
  13. this Software just like a book, except that you may copy it 
  14. onto a computer to be used and you may make archive copies 
  15. of the Software for the sole purpose of backing up the 
  16. Software and protecting your investment from loss. Your use 
  17. of this software is limited to evaluation and trial use 
  18. purposes only.

  20. FURTHER, THIS SOFTWARE MAY CONTAIN A TIME-OUT FEATURE THAT 
  21. DISABLES ITS OPERATION AFTER A CERTAIN PERIOD OF TIME. A 
  22. TEXT FILE DELIVERED WITH THE SOFTWARE WILL STATE THE TIME 
  23. PERIOD AND/OR SPECIFIC DATE("EVALUATION PERIOD") ON WHICH 
  24. THE SOFTWARE WILL EXPIRE. Though Inprise does not offer 
  25. technical support for the Software, we welcome your 
  26. feedback.

  28. If the Software is an Inprise development tool, you can 
  29. write and compile applications for your own personal use on 
  30. the computer on which you have installed the Software, but 
  31. you do not have a right to distribute or otherwise share 
  32. those applications or any files of the Software which may be 
  33. required to support those applications. APPLICATIONS THAT 
  34. YOU CREATE MAY REQUIRE THE SOFTWARE IN ORDER TO RUN. UPON 
  35. EXPIRATION OF THE EVALUATION PERIOD, THOSE APPLICATIONS MAY
  36. NO LONGER RUN. You should therefore take precautions to 
  37. avoid any loss of data that might result.

  39. 2. INPRISE MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF 
  40. THIS SOFTWARE OR ABOUT ANY CONTENT OR INFORMATION MADE 
  41. ACCESSIBLE BY THE SOFTWARE, FOR ANY PURPOSE. THE SOFTWARE IS 
  42. PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED WARRANTIES, 
  43. INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A 
  44. PARTICULAR PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS 
  45. PROVIDED GRATUITOUSLY AND, ACCORDINGLY, INPRISE SHALL NOT BE 
  46. LIABLE UNDER ANY THEORY FOR ANY DAMAGES SUFFERED BY YOU OR 
  47. ANY USER OF THE SOFTWARE. INPRISE WILL NOT SUPPORT THIS 
  48. SOFTWARE AND IS UNDER NO OBLIGATION TO ISSUE UPDATES TO THIS 
  49. SOFTWARE.

  51. 3. While Inprise intends to distribute (or may have already 
  52. distributed) a commercial release of the Software, Inprise 
  53. reserves the right at any time to not release a commercial 
  54. release of the Software or, if released, to alter prices, 
  55. features, specifications, capabilities, functions, licensing 
  56. terms, release dates, general availability or other 
  57. characteristics of the commercial release.

  59. 4. Title, ownership rights, and intellectual property rights 
  60. in and to the Software shall remain in Inprise and/or its 
  61. suppliers. You agree to abide by the copyright law and all 
  62. other applicable laws of the United States including, but 
  63. not limited to, export control laws. You acknowledge that 
  64. the Software in source code form remains a confidential 
  65. trade secret of Inprise and/or its suppliers and therefore 
  66. you agree not to modify the Software or attempt to decipher, 
  67. decompile, disassemble or reverse engineer the Software, 
  68. except to the extent applicable laws specifically prohibit 
  69. such restriction.

  71. 5. Upon expiration of the Evaluation Period, you agree to 
  72. destroy or erase the Software, and to not re-install a new 
  73. copy of the Software. This statement shall be governed by 
  74. and construed in accordance with the laws of the State of 
  75. California and, as to matters affecting copyrights, 
  76. trademarks and patents, by U.S. federal law. This statement 
  77. sets forth the entire agreement between you and Inprise.

  79. 6. Use, duplication or disclosure by the Government is 
  80. subject to restrictions set forth in subparagraphs (a) 
  81. through (d) of the Commercial Computer-Restricted Rights 
  82. clause at FAR 52.227-19 when applicable, or in subparagraph 
  83. (c) (1) (ii) of the Rights in Technical Data and Computer 
  84. Software clause at DFARS 252.227-7013, and in similar 
  85. clauses in the NASA AR Supplement. Contractor/manufacturer 
  86. is Inprise Corporation, 100 Enterprise Way, Scotts Valley, 
  87. CA 95066.

  89. 7. You may not download or otherwise export or reexport the 
  90. Software or any underlying information or technology except 
  91. in full compliance with all United States and other 
  92. applicable laws and regulations. In particular, but without 
  93. limitation, none of the Software or underlying information 
  94. or technology may be downloaded or otherwise exported or 
  95. reexported (i) into (or to a national or resident of) Cuba, 
  96. Haiti, Iraq, Libya, Yugoslavia, North Korea, Iran, or Syria 
  97. or (ii) to anyone on the US Treasury Department's list of 
  98. Specially Designated Nationals or the US Commerce 
  99. Department's Table of Deny Orders. By downloading the 
  100. Software, you are agreeing to the foregoing and you are 
  101. representing and warranting that you are not located in, 
  102. under control of, or a national or resident of any such 
  103. country or on any such list.

  105. 8. INPRISE OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR (a) 
  106. INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF 
  107. ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE, 
  108. EVEN IF INPRISE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH 
  109. DAMAGES, OR (b) FOR ANY CLAIM BY ANY OTHER PARTY. THIS 
  110. LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR 
  111. DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW 
  112. PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME STATES DO NOT 
  113. ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR 
  114. CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY 
  115. NOT APPLY TO YOU.

  117. 9. HIGH RISK ACTIVITIES. The Software is not fault-tolerant 
  118. and is not designed, manufactured or intended for use or 
  119. resale as on-line control equipment in hazardous 
  120. environments requiring fail-safe performance, such as in the 
  121. operation of nuclear facilities, aircraft navigation or 
  122. communication systems, air traffic control, direct life 
  123. support machines, or weapons systems, in which the failure 
  124. of the Software could lead directly to death, personal 
  125. injury, or severe physical or environmental damage ("High 
  126. Risk Activities"). Inprise and its suppliers specifically 
  127. disclaim any express or implied warranty of fitness for High 
  128. Risk Activities.
