  1. Lizenzbedingungen SubSpace (TM) Client-Software

  3. Computec gewΣhrt Ihnen eine einfache, nicht ⁿbertragbare Lizenz fⁿr die Software 
  4. SubSpace (TM) und der dazugeh÷rigen Dokumentation. Der Lizenzvertrag
  5. gestattet Ihnen die Benutzung der Software auf einem einzigen Computer.
  6. Sie sind zur Anfertigung einer Sicherungskopie der Software berechtigt.
  7.  
  8. Es ist Ihnen ausdrⁿcklich untersagt, 
  9.  
  10. -die Software oder Dokumentation ganz oder in Teilen zu verbreiten, zu vermieten, 
  11.  zu verleihen, zu verkaufen oder in sonstiger Weise zu vervielfΣltigen bzw. an Dritte
  12.  zu ⁿbertragen,
  13.  
  14. -die Software zu analysieren, zu untersuchen, zu dekompilieren oder zu disassemblieren,
  15.  ausgenommen in der gesetzlich erlaubten Weise,
  16.  
  17. -die Software zu verΣndern, zu arrangieren oder anzupassen oder abgeleitete Werke
  18.  auf der Basis der Software zu erstellen.

  20. Die Urheberschaft und alle geistigen und gewerblichen Schutzrechte an der Software
  21. verbleiben bei Virgin Interactive. Da die Software unentgeltlich ⁿberlassen wird,
  22. wird sie ohne jede GewΣhrleistung zur Verfⁿgung gestellt.

  24. Jeder Versto▀ gegen die vorbezeichneten Bestimmungen fⁿhrt zur automatischen
  25. Beendigung dieses Lizenzvertrags. Dies gilt in gleicher Weise, sofern der mit
  26. Computec abgeschlossene Vertrag ⁿber die Nutzung des Internet-Angebots
  27. SubSpace (TM), gleich aus welchem Rechtsgrund, beendet wird.

  30. Die Verwendung der Virgin Interactive-Warenzeichen und der Vertrieb des SubSpace-Spiels durch
  31. den Comutec Verlag erfolgt unter Lizenz. Virgin Interactive zeichnet
  32. das Copyright fⁿr SubSpace. Alle Reche vorbehalten.
  33. Der Computec Verlag ist fⁿr den Kundenservice und alles andere in Bezug auf diese
  34. Version von SubSpace alleinig verantwortlich.

  41. THE FOLLOWING CAREFULLY BEFORE USING THE 
  42. PROGRAM.

  44. LICENSE AGREEMENT

  46. This is a license agreement between you (either an individual or an 
  47. entity), the end user, and Virgin Interactive Entertainment, Inc. 
  48. ('Virgin').
  49. VIRGIN PRODUCT LICENSE

  51. 1.  GRANT OF LICENSE.  This License Agreement ('License 
  52. Agreement') permits you to use one copy of this Software and 
  53. associated files (collectively 'Software') on any single computer 
  54. system.  
  55.  
  56. 2.  COPYRIGHT.  The Software is owned by Virgin or its suppliers 
  57. and is protected by the United States copyright laws and international 
  58. treaty provisions.  Virgin retains all rights not expressly granted.  
  59. Therefore, you must treat the Software like any other copyrighted 
  60. material (e.g. a book or musical recording) except that you may either 
  61. (a) make one copy of the Software solely for backup or archival 
  62. purposes, or (b) transfer the Software to a single hard disk provided 
  63. you keep the original solely for backup or archival purposes.  You may 
  64. not copy any written materials accompanying the Software.

  66. 3.   OTHER RESTRICTIONS.  This License Agreement is your proof 
  67. of license to exercise the rights granted herein and must be retained by 
  68. you.  You may not loan, sell, rent, lease, give, sublicense or otherwise 
  69. transfer the Software (or any copy).  Notwithstanding the foregoing, in 
  70. one case you may transfer your rights under this License Agreement on 
  71. a permanent basis provided you transfer this License Agreement, the 
  72. Software, and all accompanying written materials, retain no copies, and 
  73. the recipient agrees to the terms of this Agreement.  You may not 
  74. modify, adapt, translate, create derivative works, decompile, 
  75. disassemble, or otherwise reverse engineer or attempt to reverse 
  76. engineer or derive source code from, all or any portion of the Software 
  77. or anything incorporated therein or permit or encourage any third party 
  78. to do so.  If the Software is an update, any transfer must include the 
  79. update and all prior revisions.

  81. EXCLUSION OF WARRANTY

  83. USE THIS SOFTWARE AT YOUR OWN RISK!

  85. The Software consists of a preliminary release demonstration version 
  86. of an interactive entertainment product and is being provided to you 
  87. solely for your evaluation of upcoming product releases by Virgin.  
  88. The Software may contain significant and insignificant program errors, 
  89. including errors which cause the interruption of operation of your 
  90. computer system.  Additionally, the interactive entertainment products 
  91. displayed in the Software may undergo significant changes prior to 
  92. release of generally available final versions or may not be released at 
  93. all.  As a result, the Software contained therein are provided "AS IS" 
  94. and you assume the responsibility for determining the suitability of the 
  95. Software on your system and for results obtained.

  97. VIRGIN DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, 
  98. STATUTORY OR OTHERWISE, ARISING OUT OF OR 
  99. RELATING TO THE SOFTWARE, OR ANY USE THEREOF, 
  100. INCLUDING (WITHOUT LIMITATION) ANY WARRANTY 
  101. WHATSOEVER AS TO QUALITY, THE FITNESS FOR A 
  102. PARTICULAR USE OR THE MERCHANTABILITY OF THE 
  103. PROGRAMS.  VIRGIN DOES NOT WARRANT THAT THE  
  104. OPERATION OF THE SOFTWARE WILL BE WITHOUT DEFECT 
  105. OR ERROR OR WILL SATISFY THE REQUIREMENTS OF YOUR 
  106. COMPUTER SYSTEM.  VIRGIN SHALL IN NO EVENT BE 
  107. RESPONSIBLE FOR LOSSES OR DAMAGES OF ANY KIND 
  108. RESULTING FROM THE USE OF THE SOFTWARE, INCLUDING 
  109. (WITHOUT LIMITATION) ANY CONSEQUENTIAL, 
  110. INCIDENTAL, SPECIAL, DIRECT OR INDIRECT DAMAGES OR 
  111. ANY LIABILITY FOR EXPENSE OR DAMAGE CAUSED BY ANY 
  112. DEFICIENCY, DEFECT, ERROR OR MALFUNCTION OF THE 
  113. SOFTWARE, HOWEVER CAUSED, ON ANY THEORY OF 
  114. LIABILITY, INCLUDING (WITHOUT LIMITATION) PRODUCTS 
  115. LIABILITY AND TORT, EVEN IF VIRGIN KNOWS OR SHOULD 
  116. KNOW OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.

  118. These limitations and exclusions shall apply notwithstanding any 
  119. failure of essential purpose of any limited remedy.  No dealer, 
  120. distributor or retailer of Virgin  is authorized to make any 
  121. modification or addition to this warranty.  Some 
  122. states/jurisdictions do not allow the exclusion or limitation of 
  123. warranties or liability for damages, and therefore the above 
  124. limitations and exclusions may not apply to you, and you may have 
  125. other rights which vary from state to state.

  127. U.S. GOVERNMENT RESTRICTED RIGHTS.  The Software and all 
  128. accompanying written materials are provided with RESTRICTED 
  129. RIGHTS.  Use, duplication, or disclosure by the Government is subject 
  130. to restrictions as set forth in Restricted Rights in Technical Data and 
  131. Computer Software Clause at FAR 52.227-7013(c)(1)(ii) or FAR 
  132. 52.227-19.  Manufacturer is Virgin Interactive Entertainment, Inc.
