  1. The Green OpenMusic License
  2.                 
  3. This is the Green OML. It resembles closely the
  4. liberties granted by the GPL for music. If you really
  5. want to make Free Music, you should use this license.
  6. If you need more restrictions, use the yellow or red
  7. color.

  14. I. REQUIREMENTS ON BOTH UNMODIFIED AND MODIFIED
  15. VERSIONS
  16.    
  17. The OpenMusic works may be reproduced and distributed
  18. in whole or in part, in any medium physical or
  19. electronic, provided that the terms of this license
  20. are adhered to, and that this license or an
  21. incorporation of it by reference (with any options
  22. elected by the author(s) and/or publisher) is
  23. displayed in the reproduction.

  25. Proper form for an incorporation by reference is as
  26. follows: Copyright (c) <year> by <author's name or
  27. designee>. This material may be distributed only
  28. subject to the terms and conditions set forth in the
  29. Green OpenMusic License, vX.Y or later (the latest
  30. version is presently available at
  31. http://openmusic.linuxtag.org/). The reference must
  32. be immediately followed with any options elected by
  33. the author(s) and/or publisher of the work (see
  34. section VI). The refence must be incoporated in any
  35. publication of the work, either physical or
  36. electronic. If the work is broadcasted, or the
  37. reference can not be incorporated by physical means,
  38. the reference can be ommitted with prior permission
  39. obtained from the copyright holder.

  41. Commercial redistribution of OpenMusic-licensed
  42. material is permitted.

  44. Any publication in physical form (like a CD) shall
  45. require the citation of the original publisher and
  46. author. The publisher and author's names shall appear
  47. on all outer surfaces of the product. On all outer
  48. surfaces of the product the original publisher's name
  49. shall be as large as the title of the work and cited
  50. as possessive with respect to the title.

  52. II. COPYRIGHT
  53.  
  54. The copyright to each OpenMusic is owned by its
  55. author(s) or designee. If the work covered by this
  56. license is bound to a specific transport medium (see
  57. section VI), it is possible for the author(s) or
  58. designee to publish the work on a different medium
  59. covered by a different license.

  61. III. SCOPE OF LICENSE
  62.  
  63. The following license terms apply to all OpenMusic
  64. works, unless otherwise explicitly stated.
  65.  
  66. Mere aggregation of OpenMusic works or a portion of
  67. an OpenMusic work with other works on the same media
  68. shall not cause this license to apply to those other
  69. works. The aggregate work shall contain a notice
  70. specifying the inclusion of the OpenMusic material
  71. and appropriate copyright notice.

  73. SEVERABILITY. If any part of this license is found to
  74. be unenforceable in any jurisdiction, the remaining
  75. portions of the license remain in force.

  77. NO WARRANTY. OpenMusic works are licensed and
  78. provided "as is" without warranty of any kind,
  79. express or implied, including, but not limited to,
  80. the implied warranties of merchantability and fitness
  81. for a particular purpose or a warranty of
  82. non-infringement.

  84. IV. REQUIREMENTS ON MODIFIED WORKS
  85.  
  86. All modified versions of works covered by this
  87. license, including partial works incorporated into
  88. new works, must meet the following requirements:
  89.  
  90.    * The modified version must be labeled as such.
  91.    * The person making the modifications must be
  92.      identified and the modifications dated.
  93.    * The location of the original unmodified work
  94.      must be identified.
  95.    * The original author's (or authors') name(s) may
  96.      not be used to assert or imply endorsement of
  97.      the resulting work without the original author's
  98.      (or authors') permission.
  99.    * The new work has to be released under precisely
  100.      this License, with the modified version filling
  101.      the role of the work, thus licensing
  102.      distribution and modification of the modified
  103.      version to whoever possesses a copy of it.

  105. V. GOOD-PRACTICE RECOMMENDATIONS
  106.  
  107. In addition to the requirements of this license, it
  108. is requested from and strongly recommended of
  109. redistributors that: If you are distributing
  110. OpenMusic works in physical form, you provide email
  111. notification to the authors of your intent to
  112. redistribute at least thirty days before your media
  113. freeze, to give the authors time to provide updated
  114. works. This notification should describe
  115. modifications, if any, made to the work. All
  116. substantive modifications (including deletions) be
  117. described in an attachment to the work. Finally,
  118. while it is not mandatory under this license, it is
  119. considered good form to offer a free copy of any
  120. physical form expression of an OpenMusic-licensed
  121. work to its author(s).

  123. VI. MEDIA LOCKING OPTION
  124.  
  125. The author(s) and/or publisher of an
  126. OpenMusic-licensed document may bind any publication
  127. of this work or derivative works in whole or in part
  128. on a specific transport medium (for example "digital
  129. distribution via the Internet"). Exceptions can be
  130. made with prior permission from the copyright holder.

  132. This option is selected by appending language to the
  133. reference to or copy of the license. This option is
  134. considered part of the license instance and must be
  135. included with the license (or its incorporation by
  136. reference) in derived works.
  137.  
  138. To accomplish this, add the phrase "Distribution of
  139. the work or derivative of the work is restricted to
  140. <insert medium here> unless prior permission is
  141. obtained from the copyright holder." to the license
  142. reference or copy.

  154. their terms are not more restrictive than the
  155. OpenMusic license.
