  7.                     「プログラム」を使用する前にこの使用条件をお読みくだ
  8.                     さい。IBM は、この使用条件に同意された場合に限り、お
  9.                     客様に対して「プログラム」の使用権を許諾します。 「プ
  10.                     ログラム」の入手方法 (電子的、初期導入、記録媒体また
  11.                     はその他の方法) にかかわらず、お客様が「プログラム」
  12.                     を使用されると、以下の条件に同意したものとみなしま
  13.                     す。

  15.                     Ⅰ．使用権
  16.  
  17.                          IBM は、このご使用条件 (第Ⅶ条および第Ⅷ条の条件
  18.                          を含みます。) に基づき、お客様に対して「プログラ
  19.                          ム」を一時点において一台の機械でのみ使用できる、
  20.                          非独占的で移転不能、譲渡不能な使用権を許諾しま
  21.                          す。

  23.                          お客様は、この使用条件に明記されている場合を除
  24.                          き、 お客様は、この使用条件に明記されている場合
  25.                          を除き、 1)「プログラム」を第三者に貸与、賃貸、
  26.                          販売、再使用許諾、譲渡、配布、転送もしくはその他
  27.                          移転すること、または、 2)法律の強行規定のある場
  28.                          合を除き、「プログラム」を逆コンパイル、逆アセン
  29.                          ブルもしくはその他翻案もしくは翻訳することはでき
  30.                          ません。

  32.                     II. 著作権
  33.  
  34.                          「プログラム」は、インターナショナル・ビジネス・
  35.                          マシーンズ・コーポレーション、その直接もしくは間
  36.                          接の子会社 (以下合わせて「ＩＢＭ」といいます。)
  37.                          または「プログラム」の提供者が著作権を持ち、使用
  38.                          許諾するものであり、売買の対象とされるものではあ
  39.                          りません。 お客様は、「プログラム」を予備用とし
  40.                          て複製することができます。お客様は「プログラム」
  41.                          に表示されているものと同一の著作権表示を必ず行う
  42.                          ものとします。

  44.                     III. 期間および解約
  45.  
  46.                          お客様は、「プログラム」およびそのすべての複製物
  47.                          を破毀することにより、いつでもこの使用契約を解約
  48.                          できます。また、お客様がこの使用条件に違反した場
  49.                          合には、IBM はこの使用契約を解約することができま
  50.                          す。この場合、お客様の使用権は消滅し、お客様は
  51.                          「プログラム」およびすべての複製物を破毀するもの
  52.                          とします。

  54.                     IV. 責任の制限
  55.  
  56.                          強行法規で除外を禁止されている場合を除き、IBM
  57.                          は、 「プログラム」を特定物として現存するままの
  58.                          状態で提供し、 第三者の権利の不侵害の保証、商品
  59.                          性の保証、特定目的適合性の保証または 法律上の瑕
  60.                          疵担保責任を含むすべての明示もしくは黙示の保証責
  61.                          任または保証条件を 負わないものとします。 この規
  62.                          定は、IBMの従契約者、「プログラム」の提供者また
  63.                          は開発者 (以下合わせて「提供者」といいます。) に
  64.                          対しても適用されます。
  65.  
  66.                     Ⅴ．責任の制限
  67.  
  68.                          IBM および「提供者」は、逸失利益、IBM または「提
  69.                          供者」の予見の有無を問わず発生した付随的損害、特
  70.                          別損害およびその他の拡大損害を含む直接損害または
  71.                          間接損害について責任を負いません。 国または地域
  72.                          によっては、法律の強行規定により、上記の責任の制
  73.                          限が適用されない場合があります。

  75.                     VI. その他
  76.  
  77.                          この使用契約には、お客様が「プログラム」を取得し
  78.                          た国の法律が適用されます。ただし、お客様がこの
  79.                          「プログラム」を (1) オーストラリアで取得された
  80.                          場合には、取引の行われた州もしくは地域の法律が、
  81.                          (2) 中央ヨーロッパ諸国もしくはロシア共和国で取得
  82.                          された場合には、オーストリアの法律が、 (3) エス
  83.                          トニア、ラトビアもしくはリトアニアで取得された場
  84.                          合には、フィンランドの法律が、 (4) カナダで取得
  85.                          された場合には、オンタリオ州の法律が、または (5)
  86.                          アメリカ合衆国、プエルトリコもしくは中華人民共和
  87.                          国で取得された場合には、ニューヨーク州の法律が適
  88.                          用されます。 「プログラム」を輸出する場合、お客
  89.                          様は、該当する輸出入関連法規を含む、すべての関連
  90.                          法規を遵守するものとします。 この使用契約は、こ
  91.                          の取引に関する完全な合意文書であり、事前の両当事
  92.                          者間の口頭または書面による通知等を置き換えるもの
  93.                          です。 この使用契約は、両当事者が記名押印した書
  94.                          面によってのみ変更できるものとします。

  96.                     VII. 追加条件
  97.  
  98.                          お客様は、OS/2 Warp バージョン 3、OS/2 Warp
  99.                          Connect、OS/2 Warp Server、 OS/2 Warp Server SMP
  100.                          、OS/2 Warp 4、 または WorkSpace On-Demand (以下
  101.                          「OS/2 製品」といいます。) の有効な使用権を許諾
  102.                          されている場合に限り、この「プログラム」を使用す
  103.                          ることができます。
  104.  
  105.                          この「プログラム」が IBM Software Choice のもと
  106.                          で無償で提供される場合、お客様は、許諾されている
  107.                          自己の有効な「OS/2 製品」の使用権ごとに、対応す
  108.                          る「プログラム」の複製物を作成し、これを当該
  109.                          「OS/2 製品」とともに使用することができます。

  111.                          この「プログラム」が有効なアップグレード特約を契
  112.                          約しているお客様にのみ限定されている場合 (すなわ
  113.                          ち、この場合には、お客様はこのプログラムにアクセ
  114.                          スするためにユーザーＩＤとパスワードが必要になる
  115.                          か、または、このプログラムは CD-ROM で提供されま
  116.                          す)、お客様は、アップグレード特約を契約されてい
  117.                          る自己の有効な「OS/2 製品」の使用権ごとに、対応
  118.                          する「プログラム」の複製物を作成し、これを当該
  119.                          「OS/2 製品」とともに使用することができます。
  120.  
  121.                          この場合、お客様は、必ず「プログラム」に表示され
  122.                          ているものと同一の著作権表示をそれぞれの複製物に
  123.                          行うものとします。 また、この「プログラム」のそ
  124.                          れぞれの複製物に対しても、このご使用条件が適用さ
  125.                          れます。

  127.                          IBM は、「プログラム」に対して、プログラム・サー
  128.                          ビスおよび技術的なサポートを提供します。 詳細に
  129.                          ついては、「プログラム」のマニュアルを参照してく
  130.                          ださい。

  132.                     VIII. 各国固有の条件
  133.  
  134.                          本条記載の条件は、各前条の条件に優先します。 日
  135.                          本: 追加条件は、ありません。

  137.                             o AUSTRALIA:
  138.  
  139.                               No Warranty (Section IV): The warranties
  140.                               specified in this Section are in addition
  141.                               to any rights you may have under the Trade
  142.                               Practices Act or other legislation and are
  143.                               limited only to the extent permitted by the
  144.                               applicable legislation.
  145.  
  146.                               Limitation of Liability (Section V): The
  147.                               following paragraph is added to this
  148.                               Section: Where IBM is in breach of a
  149.                               condition or warranty implied by the Trade
  150.                               Practices Act 1974, IBM's liability is
  151.                               limited to: (a) where IBM supplied
  152.                               services, the cost of having services
  153.                               supplied again; or (b) where IBM supplied
  154.                               goods, the repair or replacement of the
  155.                               goods, or the supply of equivalent goods.
  156.                               Where that condition or warranty relates to
  157.                               right to sell, quiet possession or clear
  158.                               title, or the goods are of a kind
  159.                               ordinarily acquired for personal, domestic
  160.                               or household use or consumption, then none
  161.                               of the limitations in this paragraph apply.

  163.                             o NEW ZEALAND:
  164.  
  165.                               No Warranty (Section IV): The warranties
  166.                               specified in this Section are in addition
  167.                               to any rights you may have under the
  168.                               Consumer Guarantees Act 1993 or other
  169.                               legislation which cannot be excluded or
  170.                               limited. The Consumer Guarantees Act 1993
  171.                               will not apply in respect of any goods or
  172.                               services which we provide, if you require
  173.                               the goods and services for the purposes of
  174.                               a business as defined in the Act.
  175.  
  176.                               Limitation of Liability (Section V): The
  177.                               following paragraph should be added to this
  178.                               Section: Where products or services are not
  179.                               acquired for the purposes of a business as
  180.                               defined in the Consumer Guarantees Act
  181.                               1993, the limitations in the Section are
  182.                               subject to the limitations in that Act.
  183.  
  184.                             o GERMANY:
  185.  
  186.                               No Warranty (Section IV): The warranty for
  187.                               any IBM Program covers the functionality of
  188.                               the Program for its normal use. In case a
  189.                               Program is delivered without
  190.                               specifications, IBM will only warrant that
  191.                               the Program information correctly describes
  192.                               the Program and that the Program can be
  193.                               used according to the Program information.
  194.                               The minimum warranty period is six months.
  195.  
  196.                               Limitation of Liability (Section V): The
  197.                               limitations and exclusions specified in the
  198.                               Agreement will not apply to damages caused
  199.                               by us with intention or gross negligence.
  200.                               IBM is liable for assured characteristics.
  201.  
  202.                             o IRELAND:
  203.  
  204.                               No Warranty (Section IV): Except as
  205.                               expressly provided in these terms and
  206.                               conditions, all statutory conditions,
  207.                               including warranties implied, but without
  208.                               prejudice to the generality of the
  209.                               foregoing all warranties implied by the
  210.                               Sale of Goods Act 1893 or the Sale of Goods
  211.                               and Supply of Services Act 1980 are hereby
  212.                               excluded.

  214.                             o ITALY:
  215.  
  216.                               (Limitation of Liability (Section V): The
  217.                               clause is replaced by the following: Unless
  218.                               otherwise provided by mandatory law, IBM is
  219.                               not liable for any damages which might
  220.                               arise.

  222.                             o UNITED KINGDOM:
  223.  
  224.                               Limitation of Liability (Section V): Add
  225.                               the following paragraph at the end of the
  226.                               first paragraph: The limitation of
  227.                               liability will not apply to any breach of
  228.                               IBM's obligations implied by Section 12 of
  229.                               the Sales of Goods Act 1979 or Section 2 of
  230.                               the Supply of Goods and Services Act 1982.

  232.                             OS/2 更新プログラムに対するご使用条件

  234.                     「プログラム」を使用する前にこの使用条件をお読みくだ
  235.                     さい。IBM は、この使用条件に同意された場合に限り、お
  236.                     客様に対して「プログラム」の使用権を許諾します。 「プ
  237.                     ログラム」の入手方法 (電子的、初期導入、記録媒体また
  238.                     はその他の方法) にかかわらず、お客様が「プログラム」
  239.                     を使用されると、以下の条件に同意したものとみなしま
  240.                     す。

  242.                     (1) お客様は、OS/2 WARP バージョン 3、OS/2 WARP
  243.                     CONNECT、 OS/2 WARP SERVER、OS/2 WARP SERVER SMP、
  244.                     OS/2 WARP 4、または WORKSPACE ON-DEMAND の有効な使用
  245.                     権を許諾されているものとします。

  247.                     (2) お客様は、この「プログラム」を保守の目的でのみ使
  248.                     用するものとします。
  249.  
  250.                     (3) お客様は、使用権を許諾されている 「OS/2 製品」と
  251.                     ともに使用するために個々の使用権に対応する「プログラ
  252.                     ム」の複製を 行うことができます。
  253.  
  254.                     (4) この「プログラム」の複製物に対しても、お客様が取
  255.                     得された「OS/2 製品」に同梱の「IBM プログラムのご使用
  256.                     条件」が適用されます。ただし、この「プログラム」の取
  257.                     得により、元の「OS/2 製品」のプログラムの保証またはサ
  258.                     ービスが拡張されることはありません。
  259.  
  260.                     (5) この「プログラム」は、 元の「OS/2 製品」の同機能
  261.                     を破毀し、置き換えることを条件に使用することができま
  262.                     す。
  263.  
  264.                     (6) 「プログラム」を輸出する場合、お客様は、該当する
  265.                     輸出入関連法規を含む、すべての関連法規を遵守するもの
  266.                     とします。
