  1. Micrografx Software License Agreement (with Network Provisions)
  2.  
  3. This is a legal agreement between you (an individual or an entity),
  4. the end user, and Micrografx, Inc. If you do not agree to the terms
  5. of this Agreement, promptly return the disk package and accompanying
  6. items (including written materials and binders or other containers)
  7. to the place you obtained them for a full refund.
  8.  
  9. License
  10.  
  11. 1.  Grant of License. This Micrografx Software License Agreement
  12. ("License") permits you to use one copy of the Micrografx software
  13. product ("Software") on any single computer, provided the Software is
  14. in use on only one computer at any time. If you have multiple Licenses
  15. for the Software, then at any time you may have as many copies of the
  16. Software in use as you have Licenses. The Software is "in use" in a
  17. computer when it is loaded into the temporary memory (i.e., RAM) or is
  18. installed into the permanent memory (e.g., hard disk, CD-ROM, or other
  19. storage device) of that computer. However, a copy installed on a network
  20. server for the sole purpose of distribution to other computers is not
  21. "in use." If the anticipated number of users of the Software will exceed
  22. the number of applicable Licenses, you must have a reasonable mechanism
  23. or process in place to assure that the number of persons using the
  24. Software concurrently does not exceed the number of Licenses. If the
  25. Software is permanently installed on the hard disk or other storage
  26. device of a computer (other than a network server), then the person
  27. authorized to use such computer also may use the Software on a portable
  28. computer, laptop, and home computer. If such person's authorization to
  29. use such computer ceases for any reason (e.g. termination of employment),
  30. then such person's authority to use the software on a portable computer,
  31. laptop, and home computer shall cease.

  33. 2.  Copyright. The Software is owned by Micrografx or its suppliers and
  34. is protected by United States copyright laws and international treaty
  35. provisions. Therefore, you must treat the Software like any other
  36. copyrighted material (e.g., a book or musical recording), 
  37. except that you may either (a) make one copy of the Software solely for
  38. backup or archival purposes, or (b) transfer the Software to a single
  39. hard disk provided you keep the original solely for backup or archival
  40. purposes. You may not copy written materials accompanying the Software.

  42. 3.  Other Restrictions. This License is your proof of license to exercise
  43. the rights granted herein and must be retained by you. You may not rent
  44. or lease the Software, but you may transfer your rights under this
  45. License on a permanent basis provided that you transfer this License,
  46. the Software and all accompanying written materials, you retain no copies,
  47. and the recipient agrees to the terms of this License. You may not decompile,
  48. or disassemble the Software. If the Software is an update, any transfer must
  49. include the update and all prior versions.

  51. 4.  Multiple Media Software. If the Software package contains both 3.5" and
  52. 5.25" disks, or other media, then you may use only the media appropriate for
  53. your single designated computer or network server. You may not use the other
  54. media on another computer or computer network, or loan, rent, lease, or
  55. transfer them to another user except as part of a transfer or other use
  56. expressly permitted by this License.
  57.  
  58. Limited Warranty
  59.  
  60. 5.  Limited Warranty. Micrografx warrants that the Software will perform
  61. substantially in accordance with the accompanying written materials and will
  62. be free from defects in materials and workmanship under normal use and service
  63. for a period of ninety (90) days from the date of receipt. Any implied 
  64. warranties on the Software are limited to ninety (90) days. Some states do not
  65. allow limitations on the duration of an implied warranty, so the above 
  66. limitations may not apply to you. This limited warranty gives you specific 
  67. legal rights. You may have others, which vary from state to state.
  68.  
  69. 6.  Customer Remedies. Micrografx's entire liability and your exclusive
  70. remedy shall be, at Micrografx's option, either (a) return of the price
  71. paid or (b) repair or replacement of the Software that does not meet 
  72. Micrografx's Limited Warranty and that is returned to Micrografx with a 
  73. copy of your receipt. This Limited Warranty is void if failure of the 
  74. Software has resulted from accident, abuse, or misapplication. Any 
  75. replacement Software will be warranted for the remainder of the original
  76. warranty period or thirty (30) days, whichever is longer. Neither these 
  77. remedies nor any product support services offered by Micrografx are 
  78. available for this U.S.A. version product outside the United States of
  79. America.

  81. 7.  No Other Warranties. Micrografx disclaims all other warranties, either
  82. express or implied, including but not limited to implied warranties of
  83. merchantability and fitness for a particular purpose, with respect to 
  84. the Software, the accompanying written materials, and any accompanying
  85. hardware.
  86.  
  87. 8.  No Liability for Consequential Damages. In no event shall Micrografx
  88. or its suppliers be liable for any damages whatsoever (including, without
  89. limitation, damages for loss of business profits, business interruption, 
  90. loss of business information, or other pecuniary loss) arising out of the 
  91. use of or inability to use the Software, even if Micrografx has been 
  92. advised of the possibility of such damages. Because some states do not 
  93. allow the exclusion or limitations of consequential or incidental damages,
  94. the above limitations may not apply to you.
  95.  
  96. U.S. Government Restricted Rights
  97.  
  98. The Software and documentation are provided with Restricted Rights. 
  99. Use, duplication, or disclosure by the government is subject to restrictions
  100. as set forth in subparagraph (c) (1) (ii) of the Rights in Technical Data 
  101. and Computer Software clause as DFARS 252.227-7013 or 
  102. subparagraphs (c) (1), (2) and (3) of the Commercial Computer 
  103. Software -- Restricted Rights at 48 CFR 52.227-19, as applicable, and any
  104. amendments thereto. Contractor/manufacturer is Micrografx, Inc.,

  107. This Agreement is governed by the laws of the State of Texas.
