  4. Please read this document carefully before using the contents on this
  5. Nautilus compilation disc.  By using the contents you agree to be bound
  6. by the terms listed below.  Should you not agree to these terms, promptly
  7. return the compilation disc to Metatec Corporation.  This license is
  8. effective until terminated.  Termination occurs either by your destruction
  9. of this compilation or your failure to comply with any provision hereof.

  11. In no event shall Metatec Corporation, its Directors, Officers, or
  12. Employees be liable for any damages whatsoever including, without
  13. limitation, loss of data or computer programs or the cost of recovering
  14. any data or programs, damages for loss of business profits, business
  15. interruption, claims or expenses, including without limitation reasonable
  16. attorney's fees and court costs, directly or indirectly arising out of or
  17. in connection with the processing, use, distribution, contents or
  18. exhibition of content delivered on this Nautilus compilation disc,
  19. including without limitation any liability for libel, slander, defamation,
  20. invasion of privacy, infringement of patent, copyright, trademark, or
  21. other proprietary right, or misappropriation of trade secrets, provided
  22. that such indemnification shall not apply to any liabilities, losses,
  23. damages, claims, costs, or expenses arising directly out of any malicious
  24. acts of, or intentional misuse of the content on this Nautilus compilation
  25. disc by Metatec Corporation.  This applies even if Metatec Corporation has
  26. been advised of the possibility of such damages.  Because some states do
  27. not allow the exclusion or limitation of liability for consequential or
  28. incidental damages, the above limitation may not apply to you.

  31. Metatec/Discovery Systems Warranty
  32.  
  33. Limited Warranty:  Nautilus compilation CD ROM titles are warranted for a
  34. period of thirty days from the date of receipt, covering damage that may
  35. occur in shipment.  If a Nautilus compilation disc has been found to be
  36. damaged and inoperable, as a result of shipment,  Metatec's entire liability
  37. and your exclusive remedy shall be, at Metatec's option, either a)  repair
  38. or replacement of the disc that does not meet Metatec's Limited Warranty
  39. and that is returned to Metatec with a copy of your receipt or b) return of
  40. the price paid. This Limited warranty is void of failure if use of the
  41. Nautilus compilation disc has resulted from accident, abuse, or
  42. misapplication by the user of this compilation disc. Any replacement
  43. Nautilus compilation disc will be warranted for the remainder of the
  44. original warranty period or thirty (30) days, whichever is longer.

  46. THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL 
  47. OTHERS, ORAL OR WRITTEN, EXPRESSED OR IMPLIED. THE EXCLUSION OF IMPLIED 
  48. WARRANTIES IS NOT PERMITTED BY SOME STATES. THE ABOVE EXCLUSION MAY NOT
  49. APPLY TO YOU.

  55. Nautilus compilations are owned by Metatec Corporation and protected by
  56. United States copyright laws and international treaty provisions.  
  57. Therefore, you must treat Nautilus compilations like any other copyrighted
  58. material (e.g., a book or musical recording).  
  59.  
  60. Except as otherwise expressly permitted in this agreement, customers shall
  61. not use, sublicense, rent, sell, convey, transfer, lend, disclose, publish,
  62. make available, display, copy, duplicate, alter, modify, adapt, merge,
  63. embed, disassemble, decompile, or reverse engineer the Nautilus compilation
  64. disc, or its content, unless permitted by an authorized representative of
  65. Metatec Corporation.

  67. Metatec retains right, title to and ownership, in all its tangible and
  68. intangible manifestations, all existing or new enhancements, developments,
  69. concepts, methods, techniques, know-how, processes, adaptations, derivative
  70. works, ideas, and expressions of ideas relating to Nautilus and its various
  71. compilation discs and the proprietary rights shall remain the exclusive
  72. property of Metatec Corporation.
