  1. ThermoProtect License Agreement
  2. ===============================
  3.  
  4. This Agreement constitutes a use license from the author of the
  5. ThermoProtect software package to you, subject to all of the terms and
  6. conditions herein; by using the subject software or any part thereof
  7. you agree to become a party to and be fully bound by this Agreement.
  8. If you do not agree with ALL of the terms in this Agreement, you must
  9. immediately remove the ThermoProtect package and all of its contents
  10. from all computers on which you may have placed it or them.
  11.  
  12. The order of presentation of the provisions of this Agreement are for
  13. convenience only, and are not to be construed as giving any portion 
  14. hereof any effect beyond that inherent in its actual wording.
  15.  
  16. In interpreting this Agreement: the word "or" is always to be
  17. understood as the inclusive "and/or" unless a contrary intention is
  18. obvious from the context; the word "shall" signifies a mandatory
  19. requirement agreed to by the appropriate party; the word "may"
  20. signifies an elective act of the appropriate party not forbidden by
  21. this Agreement; the words "including" and variations thereof are not
  22. restrictive but are each to be construed as meaning "including but not
  23. limited to" or such analogous phrase as the particular grammatical
  24. form of "including" requires; and the masculine, feminine, or neuter
  25. gender and the singular or plural number shall each be deemed to
  26. include the others when the context so requires.

  28. You are licensed to use the contents of the ThermoProtect package for
  29. personal purposes in a noncommercial environment for an unlimited time
  30. without charge.
  31.  
  32. You are licensed to use the contents of the ThermoProtect package for
  33. commercial purposes or in a commercial environment past a period
  34. reasonable for evaluation purposes only on your making a donation, in
  35. an amount equal to your fair estimation of the value of ThermoProtect
  36. to you, to a generally recognized charitable organization (W.H.O. is
  37. not an acceptable choice) and your subsequently e-mailing or otherwise
  38. delivering a receipt or similar demonstration of such donation to the 
  39. author of the ThermoProtect package.
  40.  
  41. You may freely redistribute this program, but only in its exact
  42. ORIGINAL ARCHIVE form, in the packed state, and only without any
  43. charge or obligation being imposed by you on any recipients.
  44.  
  45. You are expressly forbidden to:
  46.  
  47.  sublicense, rent, lease, or assign the ThermoProtect package or any
  48.  part thereof;
  49.  
  50.  decompile, reverse engineer, disassemble, or print the software
  51.  object code in any form or language or otherwise derive a source
  52.  code for the software (save to the extent that specific laws
  53.  applicable in your jurisdiction may explicitly prohibit any such
  54.  restriction);
  55.  
  56.  modify, customize, enchance, or change the software, or permit any
  57.  third party under your control to do so;
  58.  
  59.  make any derivative work based on the software; or,
  60.  
  61.  change or remove any proprietary markings, notices, or labels in the
  62.  software.
  63.  
  64. The author does NOT warrant that the Program is free from claims by
  65. any third party of copyright, patent, trademark, trade-secret, or
  66. other intellectual-property infringement.
  67.  
  68. By installing and using this program you accept it as is and with the
  69. understanding that the author offers no representation or warranty,
  70. express or implied (including any implied warranty of merchantability
  71. or of fitness for a particular purpose) concerning the ThermoProtect
  72. package or any part thereof, and that to the extent that you use or
  73. implement this package or any part thereof you do so at your own risk.
  74. In no event will the author be held liable for any damages, whether
  75. consequential, incidental, or special, arising out of your use of or
  76. inability to use the package provided herewith or any part thereof.

  78. Under no circumstances is the author liable for any of the following:
  79.  
  80.  third-Party claims against you for losses or damages;
  81.  
  82.  loss of, or damage to, your records or data; or,
  83.  
  84.  economic consequential damages (including lost profits or savings) or
  85.  incidental damages, even if the author has been informed of their 
  86.  possibility.

  88. The author does not warrant uninterrupted or error-free operation.

  90. THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED
  91. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  93. You may terminate this license at any time.  We may terminate this
  94. license if you fail to comply with any of its terms.  In either event,
  95. you must destroy all your copies of the pacakge and all parts thereof.
  96.  
  97. If any provision of this Agreement or any portion of any provision of
  98. this Agreement, including the breadth or scope of that provision or
  99. portion, is held by any court of competent jurisdiction to be in whole
  100. or in part invalid or unenforceable, this Agreement is to be
  101. interpreted as closely to its originally written sense as possible
  102. with the invalid or unenforceable provision or portion thereof
  103. stricken herefrom.

  105. Some jurisdictions do not allow all of these limitations and
  106. exclusions, so they may not all apply fully to you.
