  1. InnoTek License Agreement
  2.  
  3. THIS AGREEMENT CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU,
  4. THE END USER, AND INNOTEK SYSTEMBERATUNG GMBH ("INNOTEK"). 
  5. PLEASE READ THIS LICENSE AGREEMENT CAREFULLY, THEN CLICK
  6. EITHER AGREE OR DISAGREE. BY CLICKING  "ACCEPT" YOU ARE
  7. AGREEING TO BE BOUND BY THE TERMS OF THIS  LICENSE. IF YOU
  8. DO NOT AGREE TO THE TERMS OF THIS LICENSE,  CLICK
  9. "DISAGREE" AND RETURN THE CONNECTIX PRODUCT TO THE PLACE
  10. WHERE YOU OBTAINED IT FOR A REFUND.

  12. 1. Grant of License.  InnoTek grants you the right to use
  13. this copy of the InnoTek software program and accompanying
  14. documentation in written or electronic form (the "Software")
  15. on a single computer (i.e. with a single CPU). You may not
  16. network the software or otherwise use it on more than one
  17. computer or terminal at the same time.
  18.  
  19. 2.  Copy Restrictions; Ownership of Software.  You own the
  20. media on which the program is recorded; InnoTek retains
  21. title to the Software including copies, regardless of form
  22. or media, and to all copyrights therein.  The Software and
  23. accompanying materials are copyrighted.  You may either (a)
  24. transfer the Software to a single hard disk and retain the
  25. original Software for back-up purposes, or (b) make one
  26. copy of the Software solely for backup or archival
  27. purposes.

  29. 3.  Transfer Restrictions.  You may transfer the Software
  30. with a copy of this Agreement to another party only on a
  31. permanent basis and only if the other party accepts the
  32. terms and conditions of this Agreement.  Upon such
  33. transfer, you must transfer all accompanying written
  34. materials, and either transfer or destroy all copies of the
  35. Software.  You may not lease, rent, sublicense, merge,
  36. reverse engineer, decompile or disassemble the Software.

  38. 4.  Termination.  This License is effective until
  39. terminated.  The License will terminate automatically
  40. without notice from InnoTek if you fail to comply with
  41. any provision of the License.  You may voluntarily
  42. terminate at any time.  Upon termination, you agree to
  43. destroy or purge all copies of the Software and
  44. accompanying written materials.

  46. 5. LIMITED WARRANTY.  As its only warrant under this
  47. Agreement, InnoTek warrants the media, if any, on which
  48. the Software is provided to be free from defects in
  49. materials under normal use for a period of 90 days from the
  50. date of the delivery to you as evidenced by your purchase
  51. receipt.  EXCEPT AS EXPRESSLY WARRANTED IN THIS AGREEMENT,
  52. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY
  53. KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED
  54. TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
  55. PARTICULAR PURPOSE.  THE ENTIRE RISK AS TO THE QUALITY AND
  56. PERFORMANCE OF THE PROGRAM IS WITH YOU.  INNOTEK DOES NOT
  57. WARRANT THAT THE FUNCTIONS CONTAINED IN THE SOFTWARE WILL
  58. MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE PROGRAM
  59. WILL BE UNINTERRUPTED OR ERROR FREE OR THAT PROGRAM DEFECTS
  60. WILL BE CORRECTED.  SOME STATE DO NOT ALLOW THE EXCLUSION
  61. OF IMPLIED WARRANTIES SO THE ABOVE EXCLUSION MAY NOT APPLY
  62. TO YOU.  THIS WARRANTY GIVES YOU SPECIFIC, LIMITED RIGHTS,
  63. YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

  65. 6.  LIMITATION OF LIABILITY.  InnoTek's entire liability
  66. and your sole remedy under this License is, at InnoTek's
  67. option, either (a) return of payment as evidenced by a copy
  68. of your purchase receipt; or (b) replacement of media not
  69. meeting InnoTek's Limited Warranty.  IN NO EVENT WILL
  70. INNOTEK OR ITS VENDORS BE LIABLE FOR ANY DIRECT,
  71. CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING DAMAGES FOR
  72. LOSS OF BUSINESS PROFITS, INFORMATION, OR USE) EVEN IF
  73. INNOTEK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  74. DAMAGES.  SOME STATE DO NOT ALLOW THE EXCLUSION OR
  75. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL
  76. DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY
  77. TO YOU.
  78.     
  79. 7.  Governing Law.  This Agreement is governed by the laws
  80. of the Federal Republic of Germany.
  81.  
  82. 8.  U.S. Government Restricted Rights.  If the Software is
  83. supplied to the United States Government, the Software is
  84. classified as "restricted computer software" as defined
  85. in  clause 52.227-19 of the FAR.  The United States
  86. Government's rights to the Software are as provided in
  87. clause  52.227-19 of the FAR.

  89. 9. Export Law Assurances. You may not use or otherwise
  90. export or reexport the Software except as authorized by
  91. United States law and the laws of the jurisdiction in which
  92. the Software was obtained. In particular, but without
  93. limitation, the Software may not be exported  or reexported
  94. (i) into (or to a national or resident of) any  U.S.
  95. embargoed country or (ii) to anyone on the U.S. Treasury
  96. Department's list of Specially Designated Nationals or the
  97. U.S. Department of Commerce's Table of Denial Orders.  By
  98. using the Software, you represent and warrant that  you are
  99. not located in, under control of, or a national or  resident
  100. of any such country or on any such list.
