  1. NETWATCH - STANDARD LICENSE AGREEMENT
  2.  
  3. SOFTWARE LICENSE AGREEMENT
  4.  
  5. This License Agreement applies to the
  6. Netwatch (hereinafter referred to as
  7. Software), an OS/2 application.
  8.  
  9. The term Software means the original and all whole
  10. or partial copies including modified copies or
  11. portions merged into other software. Momotek
  12. Computer Specialties retains title to the Software
  13. and owns the copyright for the Software.
  14.  
  15. 1. GRANT OF LICENSE
  16.  
  17. This Software is licensed, not sold. Momotek
  18. Computer Specialties (hereinafter referred to
  19. as Momotek) grants you a license for
  20. Software in the country where you received the
  21. Software. You obtain no other rights other than
  22. those granted under this license.
  23.  
  24. You may use the Software and documentation,
  25. subject to the restrictions below:
  26.  
  27. (a) You will not use the Software for more than
  28. thirty days unless you obtain a registration code
  29. from Momotek or one of its authorized agents.
  30.  
  31. (b) You will not distribute copies of the Software
  32. to others except for demonstration purpouses. You
  33. will not reveal any registration code for the
  34. Software.
  35.  
  36. (c) If you distribute copies of the Software for
  37. demonstration purpouses, you will include a copy
  38. of this License Agreement.
  39.  
  40. The Software is owned by Momotek or its
  41. suppliers and is protected by U.S. and other
  42. countries' copyright laws and international treaty
  43. provisions. Therefore, you must treat the Software
  44. like any other copyrighted material and not
  45. reproduce it except that you:
  46.  
  47. (a) may make one copy of the Software solely for
  48. backup or archival purposes, or
  49.  
  50. (b) may transfer the Software to a single hard
  51. disk provided you keep the original solely for
  52. backup or archival purposes.
  53.  
  54. You may not copy the documentation accompanying
  55. the Software.
  56.  
  57. You may not sublicense, rent, lease, loan or share
  58. the Software, but you may transfer the Software
  59. and accompanying written materials on a permanent
  60. basis provided you retain no copies and the
  61. recipient agrees to the terms of this License
  62. Agreement.
  63.  
  64. You may not reverse engineer, decompile,
  65. disassemble, or translate the Software, except to
  66. the extent such foregoing restriction is expressly
  67. prohibited by applicable law.
  68.  
  69. You may not loan, rent, lease, or transfer the
  70. Software to another user except as part of the
  71. permanent transfer (as provided above) of all
  72. Software and printed materials.
  73.  
  74. 2.  DISCLAIMER OF WARRANTY
  75.  
  76. To the maximum extent permitted by applicable law,
  77. Momotek and its suppliers disclaim all
  78. warranties, either express or implied, including,
  79. but not limited to, implied warranties of
  80. merchantability and fitness for a particular
  81. purpose, with regard to the Software and
  82. accompanying documentation.

  84. 3. LIMITATION OF REMEDIES
  85.  
  86. To the maximum extent permitted by applicable
  87. laws, in no event shall Momotek or its suppliers
  88. be liable for any damages whatsoever (including
  89. without limitation, damages for loss of business
  90. profits, business interruption, loss of
  91. information, or other pecuniary loss) arising out
  92. of the use of or inability to use this product,
  93. even if Momotek has been advised of the
  94. possibility of such damages.

  96. 4.  GENERAL
  97.  
  98. The license granted to you is effective until
  99. terminated. You may terminate this license at any
  100. time if you destroy all copies of the software.
  101.  
  102. If you acquired this Software in the U.S, this
  103. license is governed by the U.S. laws. Otherwise
  104. this license is governed by the laws of the
  105. country in which you acquired the Software. Each
  106. of the parties hereto irrevocably attorns to the
  107. jurisdiction of the courts of Italy.
