  2. J STREET MAILER - STANDARD LICENSE AGREEMENT
  3.  
  4. SOFTWARE LICENSE AGREEMENT
  5.  
  6. This License Agreement applies to the J Street Mailer (hereinafter
  7. referred to as Software), a Java application.
  8.  
  9. The term Software means the original and all whole or partial copies
  10. including modified copies or portions merged into other software.
  11. InnoVal retains title to the Software and owns the copyright for the
  12. Software.
  13.  
  14.  
  15. 1. GRANT OF LICENSE
  16.  
  17. This Software is licensed, not sold. InnoVal Systems Solutions, Inc.
  18. (hereinafter referred to as InnoVal) grants you a license for Software
  19. in the country where you received the Software. You obtain no other
  20. rights other than those granted under this license.
  21.  
  22. You may use the Software and documentation, subject to the
  23. restrictions below:
  24.  
  25.         (a) You will not use the Software for more than thirty days
  26.             unless you obtain a license number from InnoVal Systems
  27.             Solutions or one of its authorized agents.
  28.  
  29.         (b) You will not distribute copies of the Software to others
  30.             except for demonstration purposes. You will not reveal any
  31.             license number for the Software.
  32.  
  33.         (c) If you distribute copies of the Software for demonstration
  34.             purposes, you will include a copy of this License
  35.             Agreement.
  36.  
  37. The Software is owned by InnoVal or its suppliers and is protected by
  38. United States and other countries' copyright laws and international
  39. treaty provisions. Therefore, you must treat the Software like any
  40. other copyrighted material and not reproduce it except that you:
  41.  
  42.         (a) may make one copy of the Software solely for backup or
  43.             archival purposes, or
  44.  
  45.         (b) may transfer the Software to a single hard disk provided
  46.             you keep the original solely for backup or archival
  47.             purposes.

  49. You may not copy the documentation accompanying the Software.
  50.  
  51. You may not sublicense, rent, lease, loan or share the Software, but
  52. you may transfer the Software and accompanying written materials on a
  53. permanent basis provided you retain no copies and the recipient agrees
  54. to the terms of this License Agreement.

  56. You may not reverse engineer, decompile, disassemble, or translate the
  57. Software, except to the extent such foregoing restriction is expressly
  58. prohibited by applicable law.

  60. You may not loan, rent, lease, or transfer the Software to another
  61. user except as part of the permanent transfer (as provided above) of
  62. all Software and printed materials.

  65. 2.  DISCLAIMER OF WARRANTY
  66.  
  67. To the maximum extent permitted by applicable law, InnoVal and its
  68. suppliers disclaim all warranties, either express or implied,
  69. including, but not limited to, implied warranties of merchantability
  70. and fitness for a particular purpose, with regard to the Software and
  71. accompanying documentation.

  74. 3. LIMITATION OF REMEDIES
  75.  
  76. To the maximum extent permitted by applicable laws, in no event shall
  77. InnoVal or its suppliers be liable for any damages whatsoever
  78. (including without limitation, damages for loss of business profits,
  79. business interruption, loss of information, or other pecuniary loss)
  80. arising out of the use of or inability to use this product, even if
  81. InnoVal has been advised of the possibility of such damages. Because
  82. some jurisdictions do not allow the exclusion or limitation of
  83. liability for consequential or incidental damages, the above
  84. limitation may not apply to you.

  87. 4.  GENERAL
  88.  
  89. The license granted to you is effective until terminated. You may
  90. terminate this license at any time if you destroy all copies of the
  91. software.
  92.  
  93. Use, duplication, or disclosure by the U.S. Government is subject to
  94. restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in
  95. Technical Data and Computer Software clause at DFARS 252.227-7013 or
  96. subparagraphs (c)(1) and (2) of the Commercial Computer Software
  97. Restricted Rights at 48 CFR 52.227-19, as applicable.

  99. If you acquired this Software in the United States, this license is
  100. governed by the laws of the State of New York. Otherwise this license
  101. is governed by the laws of the country in which you acquired the
  102. Software. Each of the parties hereto irrevocably attorns to the
  103. jurisdiction of the courts of the State of New York.

  107. InnoHelp are trademarks of InnoVal Systems Solutions, Inc. Java is a
  108. trademark of Sun Microsystems. All other trademarks and service marks,
  109. registered or otherwise, are the property of their respective owners.
