  1. License Agreement 
  2.  
  3. BEFORE USING THIS CODE AND DOCUMENTATION CONTAINED IN THIS PACKAGE, 
  4. (HEREAFTER REFERRED TO AS THE "PROGRAM"), YOU  SHOULD CAREFULLY READ THE 
  5. FOLLOWING TERMS AND CONDITIONS.

  7. This PROGRAM is licensed and not sold. ATI grants you a license for the
  8. PROGRAM only in the country where you aquired the PROGRAM. You obtain no
  9. rights other than those granted to you under this license. The term
  10. "PROGRAM" means the original and all whole or partial copies of it,
  11. including modified copies or portions merged into other programs. ATI has
  12. licensed from the owner copyrights in the PROGRAM. You are responsible for
  13. the selection of the PROGRAM and for the installation of, use of, and the
  14. results obtained from, the PROGRAM.

  17. 1.  License   
  18.  
  19.     Under the license, you may: 
  20.  
  21.     a.  use the PROGRAM only if you are a licensee of OS/2; 
  22.     b.  use the PROGRAM on only one machine at any one time; 
  23.     c.  copy the PROGRAM for backup or in order to modify it; 
  24.     d.  modify the PROGRAM and/or merge it into another program as an
  25.         essential utilization of the PROGRAM in conjunction with your
  26.         machine, and;
  27.     e.  transfer the possession of the PROGRAM to another party.

  29. If you transfer the PROGRAM, you must transfer a copy of this license, all
  30. other documention and at least one complete unaltered copy of the PROGRAM
  31. to the other party. You must, at the same time, either transfer all your
  32. copies of the PROGRAM to the other party or destroy them. Your license is
  33. then terminated. The other party agrees to these terms and conditions by
  34. its first use of the PROGRAM.

  36. You must reproduce the copyright notice(s) on each copy, or partial copy,
  37. of the PROGRAM.
  38.  
  39. Under the license, you may not: 
  40.  
  41.     a.  use the PROGRAM unless you are a licensee of OS/2; 
  42.     b.  use, copy, modify, merge, or transfer copies of the PROGRAM except
  43.         as provided in this license;
  44.     c.  reverse assemble or reverse compile the PROGRAM; or 
  45.     d.  sublicense, rent, lease, or assign the PROGRAM.

  47. 2.  Warranty

  49.     THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANY OF ANY KIND. ATI 
  50.     DISCLAIMS ALL WARRANTIES FOR THE PROGRAM, EITHER EXPRESS OR IMPLIED, 
  51.     INCLUDE, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY 
  52.     AND FITNESS FOR A PARTICULAR PURPOSE.

  54.     Some jurisdictions do not allow exculsions of implied warranties, so
  55.     the above exclusion may not apply to you.
  56.  
  57. 3.  Limitation of Remedies   
  58.  
  59.     IN NO EVENT WILL ATI BE LIABLE FOR ANY LOST PROFITS, LOST SAVINGS, 
  60.     INCIDENTAL OR INDIRECT DAMAGES OR OTHER ECONOMIC CONSEQUETIAL DAMAGES, 
  61.     EVEN IF ATI OR ITS AUTHORIZED SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY 
  62.     OF SUCH DAMAGES. IN ADDITION, ATI WILL NOT BE LIABLE FOR ANY DAMAGES 
  63.     CLAIMED BY YOU BASED ON ANY THIRD PARTY CLAIM.

  65.     The above limitations of remedies also applies to any developer or
  66.     supplier of the PROGRAM. Such developer and/or supplier is an intended
  67.     beneficiary of this Section.
  68.  
  69.     Some jurisdictions do not allow these limitations or exclusions, so
  70.     they may not apply to you.
  71.  
  72. 4.  General   
  73.  
  74.     You may terminate your license at any time. ATI may terminate your
  75.     license if you fail to comply with the terms and conditions of this
  76.     license. In either event, you must destroy all your copies of the
  77.     PROGRAM.
  78.  
  79.     You are responsible for payment of any taxes, including personal
  80.     property taxes, resulting from this license.
  81.  
  82.     Neither party may bring an action, regardless of form, more than two
  83.     years after the cause of the action arose.
  84.  
  85.     If you acquire the PROGRAM in the United States, this license is
  86.     governed by the laws of the State of New York. If you acquire the
  87.     PROGRAM in Canada, this license is governed by the laws of the Province
  88.     of Ontario. Otherwise, this license is governed by the laws of the
  89.     country in which you acquire the PROGRAM.
