  1.         LICENSE AGREEMENT FOR OBJECT REXX FOR OS/2

  3. BEFORE INSTALLING THE PROGRAM, YOU SHOULD CAREFULLY READ
  4. THE FOLLOWING TERMS AND CONDITIONS.  INSTALLING THE PROGRAM
  5. INDICATES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS.  IF
  6. YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT
  7. INSTALL THE PROGRAM.

  9. GRANT OF LICENSE:  The Program, Object REXX for OS/2, is
  10. owned by International Business Machines Corporation or one
  11. of its subsidiaries (IBM) and is copyrighted and licensed,
  12. not sold.  IBM grants you a nontransferable, non-exclusive
  13. license to use the Program.  As this Program is an
  14. application development tool, you may distribute
  15. applications created using the Program.
  16.  
  17. You may not reverse assemble, reverse compile, otherwise
  18. translate or discover the source code of the Program, except
  19. as permitted by law without the possibility of contractual
  20. waiver.  In addition, unless otherwise specified, you may
  21. not rent , lease, sublicense, assign or distribute the
  22. Program to any third party.  You agree that any information
  23. or feedback you may provide to IBM in reference to the
  24. Program or this Agreement is non-confidential and you grant
  25. IBM a worldwide, fully paid up and irrevocable license to
  26. use this information/feedback for IBM business activities.

  28. CHARGE:  IBM is offering the Program to you at no charge
  29. under this Agreement.

  31. TERM AND TERMINATION:  You may terminate your license at any
  32. time by destroying all your copies of the Program.  IBM may
  33. terminate your license if you fail to comply with the terms
  34. of this Agreement.

  36. DISCLAIMER OF WARRANTY AND SUPPORT:  IBM will not provide
  37. any service or support for the Program whatsoever.

  39. THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND
  40. EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE
  41. IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A
  42. PARTICULAR PURPOSE.  THE ENTIRE RISK ARISING OUT OF THE USE
  43. OR PERFORMANCE OF THIS PROGRAM AND DOCUMENTATION REMAINS
  44. WITH YOU.  IN NO EVENT WILL IBM BE LIABLE FOR ANY LOST
  45. PROFITS, LOST SAVINGS, INCIDENTAL OR INDIRECT DAMAGES OR
  46. OTHER ECONOMIC CONSEQUENTIAL DAMAGES, EVEN IF IBM OR ITS
  47. AUTHORIZED SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF
  48. SUCH DAMAGES.  IN ADDITION IBM AND ITS SUPPLIERS WILL NOT BE
  49. LIABLE FOR ANY DAMAGES CLAIMED BY YOU BASED ON ANY THIRD
  50. PARTY CLAIM.

  52. Some jurisdictions do not allow the exclusion of implied
  53. warranties, or the limitation for consequential damages, so
  54. the above may not apply to you.

  56. Note to U.S. Government Users - Documentation related to
  57. Restricted Rights-Use, duplication, or disclosure is subject
  58. to restrictions set forth in GSA ADP Schedule Contract with
  59. IBM Corporation.

  61. This Agreement is entered into in the State of New York,
  62. U.S.A. and governed by the laws of the State of New York
  63. without regard to conflict of law principles.  Regardless
  64. of where you access this Program from, you agree to comply
  65. with all applicable United States laws including those
  66. regarding the export of data.
