  5.                 Corporate and Governmental Site License
  6.  
  7. This is a license for use of the software within your company or goverment
  8. agency, and is not transferable.  This allows internal use and copying of 
  9. the software for as many sites / computers as contracted for.  (See the 
  10. ORDER FORM for Site License price schedule).  An unlimited Site License 
  11. allows unlimited copying of the software for internal use by your company 
  12. or government agency.  Distributing, repackaging, or reselling of the 
  13. software to third parties is not allowed.  All licenses are prepaid.

  16.                     Custom Versions of the Software

  18. If you require any modifications or changes to the software, please include 
  19. detailed written information describing all changes you are interested in.
  20. Customization fees will be based on the extent of the modifications required
  21. to the software so it performs as you describe.  Depending on the changes
  22. requested, please allow six to eight weeks for custom versions of the 
  23. software.

  48. This is a perpetual license for the use of the software within your company,
  49. and is not transferable.  This license allows internal use and copying of
  50. the software by as many users/ machines as contracted for.  Distribution, 
  51. repackaging, or reselling of the software, to third parties, is not allowed 
  52. under this agreement.

  54. LJV CONSULTING hereby disclaims all warranties relating to this software,
  55. whether express or implied, including without limitation any implied 
  56. warranties of merchantability or fitness for a particular purpose. LJV 
  57. CONSULTING will not be liable for any special, incidental, consequential, 
  58. indirect or similar damages due to loss of data or any other reason, even 
  59. if LJV CONSULTING or an agent of LJV CONSULTING has been advised of the 
  60. possibility of such damages.  In no event shall LJV CONSULTING's liability 
  61. for any damages ever exceed the price paid for the license to use the 
  62. software, regardless of the form of the claim.  The person using the 
  63. software bears all risk as to the quality and performance of the software.

  65. This agreement shall be construed and enforced in accordance with the laws 
  66. of the STATE OF CALIFORNIA.  Any action or proceeding brought by either 
  67. party against the other arising out of or related to this agreement shall 
  68. be brought only in a STATE or FEDERAL COURT of competent jurisdiction 
  69. located in Ventura county, California.  The parties hereby consent to in 
  70. personam jurisdiction of said courts.
